Summer: I can take a blood test to see if I'm the one who can save lola.
Phyllis: I trusted that you would understand why I do the things I do. I -- I asked you to have some faith in me!
Nick: You got to go. Out of this house, and out of my life.
Mariah: This terrible, awful thing, it is gonna swallow us whole.
Michael: You could save the court a lot of time and money and tell us the real story about how you came to see this video.
Michael: Shall I take the silence to mean that, yes, we should subpoena you to examine your e-mails?
Mariah: Like I said, I don't know who sent that video.
Michael: You're gonna stick to that story? Really? Oh, no, please answer out loud for the records.
Mariah: I already told you the sender of the video was anonymous.
Michael: Well, after you viewed the footage, were you in the least bit curious as to why someone would send it to you?
Mariah: Honestly, I didn't think that much about it. It didn't really make that much of an impression on me.
Michael: You recognized the women, didn't you?
Mariah: Yes.
Michael: You knew the location.
Mariah: I figured it was victoria's garage, given the date stamp.
Michael: You learned from the video that your friend was being surveilled in her own home, apparently without her knowledge. You didn't find that interesting or maybe even alarming?
Mariah: I figured victoria had a security system. Cameras are everywhere these days, so...
Michael: Did you tell victoria about it?
Mariah: No.
Michael: Did you mention it to anybody else?
Mariah: No.
Michael: Not even your own mother?
Mariah: Like I said before, it didn't really register.
Michael: Oh, well, it didn't occur to you to maybe just forward it and say something like, "oh, uh, something funny happened to me today. I got this random video of you doing this random thing."
Christine: Objection. Asked and answered.
You've made your point, counsel.
Michael: The police recovered this video from the servers at dark horse. Who has access to those computer servers?
Mariah: Why would I know?
Michael: Well, you know nicholas newman who owns the company and several people who work there. Give me some names.
Mariah: Nobody at dark horse sent me that video.
Michael: How would you know that unless you know who did send it?
Sharon: Stop this!
You've been at this a while, mr. Baldwin. What do you to uncover?
Michael: I'm just trying to be certain that the witness is sure of her statements.
Mariah: I stand by everything I said.
Michael: Then I have no further questions.
Very well. Ms. Hodges?
Brittany: You used to live with your mother at the newman ranch, if I'm not mistaken.
Mariah: That's right.
Brittany: And was there a lot of security there? Cameras?
Mariah: Tons.
Brittany: So it wouldn't have come as a shock to you that victoria newman had a similar setup at her house in town.
Mariah: Not at all.
Brittany: Going back to the night the video was taken, what was the reason sharon gave you for being up in victoria's room?
Mariah: They were doing a kind of purge, going through victoria's things to decide what to donate.
Brittany: And did what you see in that video, that same group of women moving an old household item into a car seem to be consistent with that?
Mariah: Absolutely.
Brittany: Seems that way to me, too. No further questions, your honor.

Christine: Your honor, my next witness phyllis summers has been unavoidably delayed. However, she is here now. She's parking and going through security.
We'll take a short recess.
[ Gavel bangs ]

Nikki: For a second there, i had this wild hope that phyllis decided to do the decent thing and skip town.
Victoria: I don't think we can count on her coming to our rescue. That's all up to michael now.
Nick: Hey. What was all that with, uh -- with mariah? Why did you pressure her and then just back off?
Michael: Well, I was hoping not to bring up tessa and the whole blackmail scheme and the fact that nikki paid her off to keep things quiet. Obviously it wouldn't look good, but, you know, I'll go there if I have to. Plant a seed in the jury's mind that there's more to the story behind that video than they realize.
Nick: So you were just laying the groundwork.
Sharon: Michael can't want it to come out that we were blackmailed, can he? I mean, there's no way that that's gonna help our case. And it would blow up tessa's life. Mariah's too.
Brittany: I don't pretend to know michael's strategy. In a dog fight like this, it's every legal team for itself.
Sharon: So you keep reminding me.
Brittany: I have no doubt that michael would sacrifice tessa or mariah if it'll save his clients.
Tessa: You were great, seriously.
Mariah: Thank you for saying that, but I think it obvious that I was lying my head off. I didn't dare look in christine's direction, but i could feel her eyes on me the whole time.
Tessa: Sounds creepy.
Mariah: What if she calls me on the stand again? What if she looks into nick's payroll records and figures out that you had access to the server?
Tessa: Mariah...
Mariah: If she puts you and that video together, then we are both going down -- me for perjury, and you for shaking nikki down for $250,000.
Tessa: Okay, seriously, mariah, you need to calm down. Okay? You were great up there. You didn't bring my name into it, and michael didn't, either. Even though it was scary for a minute or two.
Mariah: No, no, no, no, "scary" doesn't even begin to cover it. Michael cross-examining me like that, it was utterly terrifying.
Tessa: Nick must have told him everything. It would have been nice if they would have told you what was coming, but I think, for now, at least, we can both relax, okay?
Mariah: [ Sighs ]
Victoria: She doesn't deserve this. Not after what J.T. Put her through.
Jack: Hey, with any luck, She'll be out of here soon and back with her kids, where she belongs.
Billy: Yeah, I don't know how realistic that is after the jury saw that videotape. Courtesy of phyllis, no doubt.
Kerry: Why are you blaming her?
Billy: Come on. Who else is gonna tell the da that that even existed?
Jack: Wait, hold on. We don't know that phyllis is responsible.
Kerry: Exactly. Until we have the whole story, we should give her the benefit of the doubt.
Billy: You know, kerry, with all due respect, you don't have to go home and tell your kids that their mother isn't coming home from her work trip. Yet.
Kerry: I wonder if he and phyllis are gonna be able to work together after this.
Jack: I have a feeling phyllis is gonna find a lot of people have problems with what she's done.
Nick: Hey. I was just, uh, gonna give my dad an update, you know, since he's been barred from the courtroom by the judge. It's killing him he can't be here.
Phyllis: I promise you, I'm gonna do everything I can to put an end to all of this.
Jack: You look very deep in thought. What's going on? Did you get that text from kyle about lola? Quite a few people are being tested to see if their liver's a good match for her. No luck so far, but, you know, there's time.
Abby: And that piece that mariah did for the gc buzz, it's getting a lot of attention, so... well, hey, maybe some good samaritan will walk in off the street and save her life.
Jack: Yeah, that'd be great, wouldn't it?
Abby: Mm, it would be a miracle. I'm actually not thinking about lola right now.
Jack: What's on your mind?
Abby: That video that christine showed of nikki and the rest of them carrying that rug out of victoria's house.
Jack: Disturbing, to say the least.
Abby: It's just -- it's horrible to think that things between my sister and J.T. Got to that point. It's just, um... I wish that she had been able to come to me while the abuse was happening. I get -- I get why she would want to keep it to herself. There must have been a lot of shame and disbelief.
Jack: Not to mention denial.
Abby: Especially for someone like victoria, who prides herself in her strength and being victor newman's daughter and not taking crap from anyone, but... it just -- it breaks my heart to think about her going through all of that alone. That's why I want to be here for her. I want her to know that, no matter what, I am here. And I know that's why you're here, too. For nikki.
Jack: And for you.
Summer: Mom? Hey, what are you doing out here?
Phyllis: I am just collecting my thoughts before I go and testify.
Summer: Deciding whether to back out or not, you mean?
Phyllis: [ Chuckles ]
Summer: Would christine let that happen?
Phyllis: If by "backing out," you mean driving to the airport, getting on a flight, no matter where it's headed, I... yeah, that thought's never crossed my mind.
Summer: Right.
Phyllis: [ Chuckles ] You know I'm joking. I mean, the consequences of pulling something like that off would be catastrophic. For everyone. Besides, the truth has to come out.
[ Sighs ] There's no escaping that. One thing I can do right now is make the jury understand how terrifying that night was and hope they show the others some mercy.
Summer: Yeah. Well, hey, I'm rooting for you. You can be very persuasive when you need to be.
Phyllis: Thank you. Thank you for saying that. That's very sweet. How's it going in there?
Summer: Oh, um, I don't -- I don't know, I just got here myself. I was at the hospital checking in with kyle.
Phyllis: Poor lola. Have they found a donor yet?
Summer: Uh, you know, the hospital's been screening a lot of people, so fingers crossed, right?
Phyllis: Okay, I have put this off for as long as I can.
Nick: Hey, summer.
Summer: Dad. Hi. Hey, look, okay, before you start in on mom, I'm telling you that she is doing this for all of the right reasons, okay?
Nick: Sure she is. It's the only way she could avoid going to prison.
Summer: And she's trying to keep everyone else out, too. Seriously, dad.
Phyllis: I don't think your father wants to hear this right now.
Nick: I've heard your mother's rationale. I understand the strategy. But I'm having a hard time with is the deal she made with the da, to help lock up my family so she can save herself.
Phyllis: Nick, give me a chance to get up there, to do everything I can to get them out of this. I promise I won't let you down.
Christine: There you are. Well, come on. Time to do this.
Christine: Moving on to the girls' night at victoria'S. When she spoke about the abuse she had suffered at J.T.'S hands, how did you and the other women react?
Phyllis: It was shocking. It was disturbing. The J.T. That she was describing was...nothing at all like the guy we had come to know. He was a man who put her down every chance he got. He broke her spirit.
Christine: Must have been hard for nikki to hear.
Michael: Objection, your honor.
Sustained.
Christine: I'll rephrase. Did you notice a difference in nikki's demeanor when victoria spoke about the pain she had been through.
Nikki: Absolutely. What I could was that she was heartbroken, she was devastated.
Christine: Are those the only emotions you observed?
Phyllis: Nikki was deeply concerned. She was upset.
Christine: Angry?
Phyllis: Sure, as any mother would be.
Christine: At what point were you aware that J.T. Was in the house?
Phyllis: Victoria went up to try to collect herself while the others stayed downstairs, and, um... we just started hearing a lot of noise -- yelling, door slammed, people running.
Christine: And what happened next?
Phyllis: We raced upstairs to victoria's bedroom.
Christine: Were you the first one up there?
Phyllis: No, uh, nikki and sharon went ahead of me.
Christine: So you were able to see what everyone else was doing in the room.
Phyllis: Yes.
Christine: And what was going on? What is the first thing you saw?
Phyllis: J.T. Was attacking victoria. He was yelling at her, screaming at her, right in her face. He had her pinned up against the dresser, and she was powerless. She couldn't move. She was yelling "stop! Stop! Get off me!
Christine: Was he hitting her?
Phyllis: No.
Christine: Did he appear to be hurting her?
Phyllis: When someone that strong grabs you and pins you like that, of course he was hurting her. J.T. Had already knocked her down before we got upstairs.
Christine: And when did you learn about that?
Phyllis: Later.
Christine: Later.
Phyllis: That wasn't all. He was pounding his first on top of the dresser, right near her head, right near her ear, sending her the message that she could be next.
Christine: You say he was sending her a message. What exactly was he saying to her, out loud?
Phyllis: He was saying something like, "why are you doing this to me?" He was playing the victim.
Christine: [ Sighs ] Is it true earlier in the evening victoria confessed that, in the past, she had hit J.T.?
Phyllis: I don't recall.
Christine: Don't forget, you're under oath.
Phyllis: Even if she had, it was nothing compared to what J.T. Did to her. He was taller, he was stronger, he was physically larger than her. Victoria could never be a threat to him.
Christine: Could you really say that when you are here to testify that victoria aided and abetted in the man's murder?
Michael: Objection, your honor, objection!
Phyllis: It wasn't murder, it was self-defense! We had no choice!
Nick: Of course it was self-defense!
Order! I will have order in my court! Including from you, ms. Summers.

Christine: When you walked into victoria's bedroom behind nikki and sharon and you saw that J.T. And victoria were in a heated argument, what did you do?
Phyllis: I froze. I'm not proud to admit that.
Christine: What about the others?
Phyllis: Sharon and I both just stood there.
Christine: What about nikki? Did nikki freeze at the doorway?
Phyllis: Nikki reacted instinctively, out of a mother's love to protect her child's life.
Christine: No, no, no. Just the facts -- what you heard, saw, and did, not what you imagine someone felt or what their motives were. I will ask you again. What did nikki do?
Phyllis: She picked up the fireplace poker.
Christine: This one?
Phyllis: Yes.
Christine: And where was it in the room?
Phyllis: Just to the right of the door?
Christine: How much time had passed from when nikki walked in the room to when she picked up the poker?
Phyllis: A few seconds.
Christine: A few seconds. So it wasn't just her instinct, it was her first instinct.
Phyllis: Is that a question?
Christine: Can you come demonstrate for the jury how nikki was holding this.
Phyllis: You want me --
Christine: Yes, come down, so they can see you. Show us. Would you assist? If you'll stand in for the deceased... now, show us where nikki was after she grabbed the poker relative to where J.T. Was standing. Please show us how and where nikki hit J.T.
Phyllis: J.T. Was faced the other way.
Christine: Oh. He had his back to her? I'm sorry, I didn't hear you. You have to speak audibly for the record.
Phyllis: J.T. Was busying terrorizing victoria, so, yes, his back was turned.
Christine: [ Sighs ] Would you please turn around the face the other way? Is that more accurate?
Phyllis: Yes.
Christine: Excellent. Now, please show us where nikki hit J.T. So she sneaked up on J.T. And hit in the back of the head. Is that your testimony?
Phyllis: "Sneaked up" are your words. What I'm trying to explain --
Christine: We're done here. You can take your seat at the witness stand.
Phyllis: Your honor, I know the laws in this state, and when there is an intruder in your home and you're afraid for your life or someone else's, you do not have to warn them before taking action.
Christine: Who is supposed to be the intruder in this scenario?
Phyllis: J.T. Hellstrom.
Christine: They had been living together for quite some time, right?
Phyllis: No, they had broken up. He had left by then.
Christine: Well, to your knowledge, had victoria obtained a restraining order?
Phyllis: No.
Christine: Did he still have personal items there?
Phyllis: Yes, but --
Christine: Then regardless of their status as a co-habitating couple, he was a lawful resident there. Legally, he had every right to be there. So whether he walked in through the front door or not is irrelevant.
Brittany: Objection.
Michael: She beat me to it.
You can argue your case when the time comes, counsel.
Christine: Forgive me. Let's talk about the cars in the driveway. Where did the guests park? Were they -- were they visible from victoria's driveway, or out front?
Phyllis: I suppose.
Victoria: So if J.T. Saw nikki's car out front and he wanted to avoid an angry confrontation with his former mother-in-law, which, knowing what we know now, would have have been a prudent move.
Phyllis: You are twisting this around. J.T. Was dangerous. He would have killed victoria if we hadn't gone upstairs. This was self-defense.
Ms. Summers, this is your last warning. If you have one more outburst, I will hold you in contempt. The jury will disregard the witness' last statement.
Christine: I am merely trying to ascertain the facts of the situation. And the fact is, nikki didn't give J.T. Any warning. She didn't tell him to stop, she didn't tell him to back down.
Phyllis: No.
Christine: Did she make any attempt to intervene other than applying excessive lethal force with a metal object to the back of his head? I mean, the man literally never knew what hit him. That is about as far from self-defense as it gets!
Michael: Your honor! Please.
Christine: He was down. He was dead at your feet. Did the four of you honestly think that anyone would believe this is self-defense?
[ Scoffs ] I mean, you didn't, did you?
Phyllis: No.
Christine: Did you think about calling the authorities?
Phyllis: Yes, but I talked them out of it.
Christine: Oh, my god, so, the four of you, you rolled him up in a rug, you drove him to chancellor park, and you buried him in the dirt, correct?
Phyllis: Yes!
Christine: J.T. Touching victoria sent nikki over the edge, and she was determined to make him pay. That is not self-defense. That's vengeance. That's murder.
Michael: Objection!
Ms. Williams, you've been warned.
Christine: Forgive me. I'm through with this witness.

Michael: Ms. Summers. You're a witness instead of a defendant because you cut a deal with the state, isn't that right? You offered to testify to avoid prosecution for your role in the events surrounding J.T. Hellstrom's disappearance.
Phyllis: That's one interpretation.
Michael: But factual, nonetheless. And, note, I used the word "disappearance" because it has yet to be proven beyond a reasonable doubt that J.T. Hellstrom is deceased.
Christine: Objection. Counsel is aware forensic evidence exists proving that J.T.'S body was buried in chancellor park.
Michael: And as ms. Williams is equally aware, I plan on calling my own expert witness to refute that conclusion.
Overruled.
Michael: If I'm not mistaken, you expect the jury to believe that you helped these women bury J.T.'S body in the park. So... why hasn't a body been found there?
Phyllis: I don't know.
Michael: You don't know.
Phyllis: I cannot explain.
Michael: That's it? You have nothing else to offer? You expect these 12 intelligent men and women to buy into your absurd story on faith?
Phyllis: Someone moved the body. I don't know why, I don't know how.
Michael: And that sounds perfectly reasonable.
Keep it classy, mr. Baldwin.
Michael: Mm. Um, early on in ms. Williams' direct examination, she mentioned that you have a long history with the newmans. In fact, a lot of those interactions with them over the years have been ugly and painful, have they not?
Phyllis: I would say some, not a lot.
Michael: Oh, regardless of the exact numbers, there are scores to settle, right?
Phyllis: Not with nikki or victoria.
Michael: How about victor?
Phyllis: We had our disagreements.
Mia: Mm. "Disagreements." Such as the one involving marco annicelli, in which victor showed a wanton disregard for your safety and well-being.
Phyllis: What would you like me to do, admit that I hate the man?
Michael: Do you?
Phyllis: Yes. I despise victor. This is widely known fact. But I've been able to separate that from my dealings with the family.
Michael: What about your feelings for billy abbott, with whom you have been recently romantically involved? Are you able to separate that out of your relationship with his ex-wife victoria?
Phyllis: Billy abbott has nothing to do with my decision to testify.
Michael: Doesn't he? A few months ago, didn't you warn victoria to stay away from him?
Phyllis: Don't make it sound a threat. It was friendly advice.
Michael: Ah, I see, and when victoria chose to ignore your "friendly advice," did you not purposely interfere and cause problems between those two?
Phyllis: Nothing is stopping them from having a relationship, if that's what they want.
Michael: A prison sentence might. Don't tell me you haven't thought about it.
Phyllis: I haven't thought about that. I'm here to help the defendants. All of them.
Michael: Really? How long would you say it took for you to strike your bargain with the district attorney? Nanoseconds?
Mr. Baldwin.
Michael: I'm sorry, your honor, I just hate hypocrisy.
Phyllis: How am I being a hypocrite?
Michael: After you were arrested, did you hire a lawyer?
Phyllis: No.
Michael: "Accessory to murder" and "obstruction" -- a reasonable person might think those are serious charges. Did you?
Phyllis: Of course I did.
Michael: And yet, instead of wisely searching out legal advice, you signed on as the district attorney's star witness. And it was not something you did to help these three women. That's laughable. It was a panic move on your part because you were desperate to save your own skin. Wasn't it?
Brittany: How would you describe your relationship with sharon newman?
Phyllis: We've never been friends.
Brittany: That's kind of an understatement, don't you think? In fact, you two were bitterly contentious rivals.
Phyllis: Your words, not mine.
Brittany: All right, then. So, the jury can get an accurate depiction, let's go through some of your history with my client, shall we? After sharon's daughter cassie was killed in an accident and her marriage to nick newman was in rough shape, you became sexually involved with him. Did you not?
Phyllis: That was years ago.
Brittany: Not the kind of thing a person forgets. And then, after they were divorced, and you were married to nick, isn't it true that sharon returned the favor by getting pregnant with faith?
Phyllis: Yes.
Brittany: And more recently, when you were having problems with billy abbott, you had an affair with nick a second time, when he was engaged to sharon.
Phyllis: That wasn't an affair.
Brittany: How would you characterize it?
Phyllis: It was one night -- one night together when billy abbott and I were split up.
Brittany: When sharon found out, on the day of their wedding, that her worst nightmare had repeated itself, she broke things off with nick, pretty publicly, correct? And now you and he live together?
Phyllis: No.
Brittany: Did you split up?
Christine: Objection. Relevance.
Brittany: Your honor, I think the witness can explain for herself whether her decision to pursue immunity from prosecution is relevant to her relationship ending.
I'd like to see where this is going.
Phyllis: I'd prefer not to answer the question, your honor.
Brittany: No problem. I'll call up nick to the stand and ask him to explain.
Phyllis: Yes. It was relevant.
Brittany: And now that you and he are finished, I assume you're worried that he'll patch things up with sharon.
Phyllis: You assume wrong.
Brittany: What a remarkably efficient strategy. Eliminating not one, but two rivals with just one day of false testimony. Congratulations.
Christine: Objection.
Brittany: Withdrawn.
Brittany: I have no further questions, your honor.
Well, the witness may step down. That concludes today's session. We'll continue tomorrow morning with the state's next witness. Court is adjourned.

Michael: Counselor? Excuse me.
Sharon: Lawyers three, phyllis zero.
Nikki: [ Exhales sharply ] They did a number on her.
Sharon: Well-deserved.
Victoria: As bad as they made phyllis look, I'm afraid that her testimony about us is incredibly damning.
Nikki: Christine is in rare form. And I don't think phyllis realized she could be manipulated so easily.
Victoria: Not to mention the evidence that she turned over.
Nikki: Yeah, well, about the only thing we can do about that is hope that the jury was swayed by her grudges against us.
Victoria: Please remind me to send michael and brittany a fruit basket from prison.
Nikki: Bite your tongue.
Sharon: Did either of you know that nick and phyllis had broken up?
Nikki: No. It was news to me, but... not really very surprising, is it? I mean, my son's first loyalty is to family, and given the way phyllis betrayed us...
Victoria: Remember the way that she lit into sharon for suggesting that we confessed to save dad? And then phyllis opens her big mouth and screws us all over.
Nikki: She was never an ally. It was a mistake to trust her.
Phyllis: Can you believe what just happened in there?
Summer: It is so obvious that christine cares way more about winning than the truth. It is so wrong.
[ Door opens ]
Phyllis: I didn't know. That was not my intention. With what happened in there. I had no idea that christine was gonna put a spin on it like that. She knew things that I didn't even tell her. Someone else must have talked, too!
Mariah: You threw them to the wolves. Do you really expect any sympathy?
Abby: You got played by one of the best -- make that three of the best. Welcome to the big leagues.
Billy: Michael was right, phyllis. It's not that you didn't know what was going down, it's that you didn't give a damn.
Summer: Okay, you know what, you don't have to stand here and take this. Let's just go, mom. Come on.
Billy: Okay, listen to me. Once the media gets hold of phyllis' testimony, that ugliness is gonna be spread all over jabot, too. We need to act, jack. Now.
Jack: As savvy as phyllis is, I don't think she saw this coming, I honestly don'T.
Billy: [ Sighs ]
Jack: But you're right. We have to get in front of this. We can't let her bring the company down with her.
Nikki: Well, I must say, the two of you handled phyllis perfectly.
Brittany: She left herself wide open.
Sharon: I do have some questions, michael, about the way you dealt with mariah.
Michael: I have some questions, too. Why did I just learn the background on that video, and not from any of you? Why do you continually keep secrets from me? I am here to protect you. I am here to defend you, but you make my job so much harder than it needs to be by refusing to trust me. The secrets, the lies of omission, the conflicting stories... I cannot construct an effective defense if you won't cooperate, and I've been telling you this from the beginning, but it doesn't seem to be sinking in that you'll be the ones to pay the price.
Jack: I know how hard you and the entire team have been working to get jabot back on solid ground. I'm afraid that's in jeopardy with this latest sordid mess.
Kerry: Why don't we just see how things unfold, hmm? It may not be as dire as you're imagining.
Jack: I'm sorry, I have seen the devastating impact that a crisis like this can have on public opinion. I think it's gonna be necessary for phyllis to step down. For the good of the company.
Kerry: I think you're right to be concerned, but it's way too soon to be talking that way. We're nowhere near a verdict.
Jack: I appreciate your loyalty, I do. Word to the wise -- don't expect the same kind of loyalty from phyllis. She's not someone who can be trusted. Ask that of any of the women about to be walked back to their cells. See how trusting phyllis paid off for them.
Billy: You think there's any truth to it? What michael and brittany said in there?
Nick: Which part?
Billy: We both know phyllis has a jealous streak. Do you think that's why she turned on sharon and victoria?
Nick: Mm, man, I don't want to believe that.
