Episode # 10011 ~ Phyllis' Trial Takes a Surprising Turn; Jack Gives Victor Shocking News

Victor: Fen, when Summer ran out on you, did she say where she was headed or who she might want to see?
Nick: Think hard, Fen. This is important.
Lauren: Nick, he's told you everything he knows.
Victoria: Fen. Oh, thank God. Oh. (Sighs)
Billy: You all right, Buddy?
Nick: He's fine. We still don't know where Summer is.
Victoria: Well, we went to all of the places that you suggested, but there's no sign of her.
Billy: And Nikki's staying at the ranch house in case she shows up.
Victoria: I don't understand why Summer's not answering her cell phone.
Nick: When I grounded her, I took her phone from her. Now I have no way to get a hold of her.
Victor: Fen, how did you contact Summer?
Fen: Well, she bought a burner, a disposable phone.
Nick: Do you happen to remember that number?
Fen: The whole number? Who remembers phone numbers?
Nick: All right, then, let me see your phone. Let's try it this way. Did she call you on this number?
Fen: Mm-hmm.
(Cell phone rings)
Summer: (Sighs) You on your way back?
Nick: Summer, it's me, it's your dad. Where are you? Everyone's worried sick.
Summer: I'm fine, Dad, I just needed to get away from everything.
Nick: Sweetheart, you gotta come home, all right? I promise you, we're gonna figure all this out. Just come home.
Summer: Is Mom's trial still on?
Nick: Are you thinking of going to the courthouse? 'Cause if so, I'll go with you. I don't want you going alone.
Summer: I need to go home and clean up, but I'll let you know what I decide.
Nick: All right, I'll call Ronan, tell him to call the search off.
Nick: She's going home.
Victoria: Oh, thank God.
Victor: I'll let security know, okay?
Nick: Here. Thanks for all your help, Dad.
Victor: Yep.
Billy: (Clears throat)
Nick: (Exhales slowly)
Victoria: So you're actually going to Phyllis' trial?
Nick: Well, it depends. Summer's my primary concern right now.
Victoria: Mm-hmm. What about Phyllis?
Nick: Phyllis made this bed of lies.
Victoria: Yeah, among other things.
Nick: Well, I'm also not looking forward to watching Phyllis' future go up in flames.
Kevin: ...So help me God.
Michael: Mr. Fisher... do you recognize this man?
Kevin: (Exhales sharply) Of course I do. That photograph was in the newspaper.
Michael: Let the record show that the man in the photograph is... was Tim Reid, the deceased. Ever seen him in person? Let me narrow this down for you even more. Did you ever see this man at Phyllis Newman's penthouse on the night of august 17th of this year?
Kevin: That was a long time ago.
Michael: Two months.
Kevin: It's such a specific date. I can't be expected to remember every night from the past two months.
Michael: Many people have calendars.
Kevin: (Laughs) So, what, am I supposed to be writing down everything I do every day, on the off chance I get called into court to testify?
Michael: Let me make this easier for you-- when was the last time you saw Tim Reid?
Kevin: What do you mean by "Saw"?
Michael: Let me remind you that you're under oath, and that there's a penalty for contempt and perjury.
Kevin: Got it.
Tucker: You look surprised to see me, Jack.
Jack: I am. I thought it would take you more than half a day to raise bail.
Tucker: Oh, no bail. The charges were dropped. It seems what little evidence there was against me has, uh, mysteriously disappeared.
Jack: Genevieve spoke to the--
Tucker: Totally irrelevant now, and I'm confident Sharon will recant her story. So bottom line, um, S.E.C. and I are buddies again.
Jack: Just like that.
Tucker: Just like that. You know me. I've always had kind of a love/hate relationship with the feds.
Jack: So how much did it cost you this time?
Tucker: You're not the only one with connections, Jack. So can we talk? I think we have some unfinished business.
(Thumping, footsteps)
Sharon: Oh, my gosh. Noah, I... (Exhales slowly) I thought-- never mind what I thought. Hi! Good to see you.
Noah: Sorry, I didn't mean to startle you. I just--I-I was hoping to be gone before you got back.
Sharon: Oh. So you're--you're packing your stuff already. Are you headed back to New York?
Noah: Actually, I decided to stay in Genoa City for awhile.
Sharon: Oh, okay. Well--well, that's great. Um, what changed your mind?
Noah: New York wasn't what I thought it was gonna be. This is my home. I can stay here, just figure some things out for awhile.
Sharon: Well, you know, if you've decided to stay, this is your home, too.
Noah: I don't think so, Mom.
Sharon: Where are you planning to live?
Noah: I haven't figured that out yet.
Sharon: Noah, stay with me. Come on. I'd love to have the company.
Noah: Doesn't work for me, Mom, but I'm moving in with Dad till I figure some things out. I gotta finish packing.
Sharon: Okay, well, why doesn't it work for you?
Noah: (Sighs) It was bad enough that you hooked up with Adam, but the stuff that you pulled with Grandpa and Tucker... I-it's hard for me to even look at you right now. It...
Victor: Ready for a shock? Tucker was released.
Billy: Are you kidding me?
Victor: No.
Victoria: How can this be? I don't understand.
Nick: He manipulated the stock price.
Victor: Yes. Of course he did. I also know that he bought a hell of a lot of shares of our company through shell corporations. That way, he didn't have to report it. The case against him is dropped. Now we have to make doubly sure that we build a very strong defense against the possibility of Jack Abbott taking over the company.
Victoria: Have you talked to Adam?
Victor: Yeah. He's not siding with our interests, which does not surprise me.
Adam: Ah, I printed our boarding passes.
Chelsea: Oh? To where?
Adam: Nope. No, no, no, it's a surprise.
Chelsea: Okay. What should I pack?
Adam: Very little.
Chelsea: Mm.
Adam: Yeah, I figure this is our last big hurrah before baby makes three. I promise, you're gonna love it.
Chelsea: As long as I'm with you, I'm sure I will.
Kevin: I used to see Tim Reid at the bookstore quite a bit, but I can't remember the last time I saw him there.
Michael: I didn't ask when the last time you saw Tim Reid at the bookstore was. I asked when the last time you saw Tim Reid was, period.
Kevin: And I told you that I don't have a perfect memory, so I don't remember.
Judge Rice: Counsel, if you'd like to declare Mr. Fisher a hostile witness--
Michael: No, no, no, that won't be necessary, your honor. Let me ask you this question-- the last time you saw Tim Reid, was he alive?
Judge Rice: (Breathing heavily)
Michael: Judge? You okay?
Judge Rice: Room's spinning.
Michael: Bailiff, come here, please.
Man: Court's in recess.
Judge Rice: Uh, uh, I have--I have medication.
Michael: All right, all right, let's get you down.
Man: I'll help you to your chambers.
Michael: All right.
Judge Rice: (Moans)
(Gate swings shut)
Phyllis: If--if--if something is--is wrong with the judge, I mean, if he got sick, there could be a mistrial, right?
Leslie: No, no, probably not, but there could be a suspension, or another judge could take over.
Avery: That might not be such a bad thing, Phyllis.
Phyllis: Have--have-- have you heard from Summer? Has anyone heard from Summer? No?
Daniel: Not a word, not a word. Here, I'll text Nick again.
Phyllis: Fen. Oh, Fen!
Michael: Oh, my God.
Michael: Where have you been?
Lauren: He showed up a little while ago at the coffeehouse.
Fen: I'm--
Michael: How you feeling? You okay?
Fen: I'm fine, Dad. Everything's cool.
Lauren: No, it's not cool. You lied to us, and you didn't tell us where you were.
Fen: Summer needed me.
Michael: Listen to me. How many times have we told you that whenever-- whenever you're out, you call us?
Lauren: Hey.
Michael: It doesn't matter what kind of trouble you're in.
Fen: I'm sorry! I-it's just-- she was a mess, you know? I-I didn't think she ought to be alone.
Phyllis: Fen, it-- wh-where's Summer? Isn't she with you?
Fen: I-I don't know where she is now.
Lauren: Nick managed to reach her, and she's on her way home.
Phyllis: What, isn't-- isn't she coming here?
Fen: Probably not. I don't think Summer wants to be around you right now.
Nick: I understand congratulations are in order.
Adam: Thank you... but I'm sure that's not why you drove all the way out here.
Nick: I'm hoping the concept of family might mean a little more, now that you're starting your own. Part of the reason I'm so determined to protect Newman is because of my children and the kids they'll have one day.
Adam: Dad told you about my decision.
Nick: He did, but I'm guessing you don't know that the S.E.C. has dropped all its charges against Tucker McCall, which means he's a serious threat to our company again.
Adam: Not my problem.
Nick: Oh, it is, Adam. It's a Newman family problem.
Adam: Don't talk to me about family. The Newmans have never bothered treating me like I'm part of your little coven-- that is, of course, unless you need something.
Nick: Are you that selfish, that you would allow an outsider to take our company from us?
Adam: This is highly entertaining, coming from the guy who always treats me like an outsider.
Jack: What do you want from me, Tucker?
Tucker: Oh, it's not what I want from you, Jack. It's what you want from me. You don't have enough of what you need to make a move against Newman.
Jack: What makes you think I still want that?
Tucker: Come on, Jack. We both know how much you'd love to take what belongs to Victor-- the whole damn empire, everything he's spent a lifetime building. It could all be yours, and as an extra added bonus, you can wipe that smirk off his face for good. (Laughs) Look at you. You're practically foaming at the mouth. All you need is one thing-- my help.
Sharon: Hey, Noah. Stay with me. Come on. Look, don't shut me out. You have no idea how hard all of this was on me or what I went through. You know, when Victor abandoned me on our wedding day--
Noah: Grandpa didn't abandon you! Mom, he was sick. He had no idea who he was or even what he was doing.
Sharon: And I had no way of knowing that.
Noah: Did you look for him?
Sharon: Yes, of course I did. Look, you don't understand. There were a lot of things all happening at once.
Noah: Mom, you can try to justify this all you want, but you've done some terrible things, and I don't believe for a minute that you're sorry.
Sharon: Noa-
Noah: I'm ashamed of what you've been doing, Mom. Okay, you need to take a long, hard look at your life and make some serious changes, and until you do, we have nothing to say to each other.
Nick: See, I thought you were trying to follow a new path. What was it? You were a new man?
Adam: (Clicks lips) I am, preferably one that has nothing to do with any of you. And by the way, Nicholas, even if I did give a damn, I don't have enough shares to help Dad get control back, so it appears as though you've wasted your time today.
Nick: You keep saying how much you've changed. It's a joke. You're a joke. You're the same selfish, miserable bastard you've always been.
Adam: I love you, too. Say hi to Phyllis for me.
Nick: (Sighs) Congratulations on the baby.
Chelsea: (Exhales slowly)
Adam: Did he honestly think he could come in here and just save the day?
Chelsea: Do not let him ruin our plans.
Adam: Nicholas ruin our plans? Not a chance.
Chelsea: (Chuckles)
Victoria: All right, well, the word's going out to remind the public that we'll be buying back shares at a premium.
Victor: Good.
Victoria: Yep. In the meantime, I will keep my ear to the ground.
Victor: I want you to do that, okay? And if you can find out anything from Billy as to Jack's activities, I'd appreciate it.
Victoria: (Sighs) Dad... I will gladly help you defend the company, but I draw the line at spying on my husband. Please, please, don't ask me to do that.
Victor: Oh, I would never do that. I just hope that my legacy to you, namely this company, matters half as much to you as your marriage.
Billy: Hey, Jack! Did you hear the charges were dropped--?
Jack: Dropped against Tucker? Yeah, I heard.
Tucker: Good to see you, Jack. Hey, Billy.
Billy: Hi. Bye. Okay, what's going on?
Jack: Tucker and I have come to a very comfortable understanding. How did you find out about charges being dropped?
Billy: From Victor. I want the scoop on that, and about this "Understanding" you have with the guy who broke Ashley's heart. What the hell is going on, Jack?
Jack: Forget about the story, Billy. In fact, forget about "Restless Style." I am about to make a move on Newman Enterprises, and when I succeed, I'm gonna need your help.
Billy: Oh, a hostile takeover with Tucker's support. Well, Victor must know about that. Explains why he was so pissed at Adam for not throwing in with the rest of the family.
Jack: Wait, Adam didn't side with the family?
Billy: Look, I know you didn't ask my opinion, but you already have Jabot to--
Jack: This is a tremendous business opportunity, Billy.
Billy: Who are you talking to? I'm your brother. This is about your never-ending feud. Victor banged you around for a few years, and now you're looking to get a little revenge. Just admit that much.
Jack: When I take control, I want you to come work for me. It'll be all hands on deck to begin with.
Billy: Wait, stop. Stop. Forget it. This is my family, this is my wife's family that you're messing with. I'm not putting my marriage on the line again, so whatever you have planned, I'm sorry, Brother, but just leave me out of it.
Phyllis: Is your sister staying away just to punish me, or is that just a cover 'cause it really is painful to see your mother go through this?
Daniel: I'm-- I'm not Summer, Mom. I can't answer that question.
Phyllis: Summer. Thank you for coming. Thank you. It means a lot to me.
Summer: I'm here for one reason-- to see you get the punishment you deserve.
Phyllis: I'm sorry you feel that way.
Summer: I'm sorry I have you as a mother.
Daniel: Whoa, whoa, whoa--
Summer: Stay out of this, Daniel.
Phyllis: Um... uh... (Sighs) Listen, uh, if you're trying to hurt me, you've succeeded.
Summer: Until I walked in here and saw you again, I don't think I realized how much I hate you.
Nick: Summer! Summer, not another word. I told you to tell me if you were coming here. I didn't want you two getting into it.
Summer: Hello to you, too, Dad.
Phyllis: Thank you for showing up.
Nick: I'm here for Summer.
Man: Court's in session, the Honorable Judge Roy Daley presiding.
Judge Daley: Be seated.
Judge Daley: Judge Rice is in the hospital so I'm stepping in, but I'm gonna need some time to look over the case before I can take over. The jury has been sequestered in the building.
Leslie: Your honor, the defense moves for a dismissal.
Judge Daley: Well, I'll take that under consideration, Counsel, but I'm gonna need some more time to look over the file, and then I'll decide if we can proceed today. Court is in recess.
Phyllis: Wh-what--what does that mean? What does that mean?
Avery: There are a lot of ways this could go. What do you know about the judge?
Leslie: Not much. I've heard he's tough, but fair.
Phyllis: That tells us nothing.
Avery: Okay, relax. We know nothing yet, okay? Let's just deal with the obstacles as they arise.
Chris: So it's a hiccup. These things happen.
Michael: I agree. It shouldn't affect the case.
Heather: What are the odds of this running into the evening?
Michael: (Chuckles)
Paul: So how full is his docket?
Michael: Jammed. If Judge Daley takes over all of Judge Rice's calendar, we could be looking at a late one.
Paul: Well, you know what? We've waited 20 years for this. A few more hours aren't gonna hurt.
Chloe: Okay, well, maybe this will give you some time to figure out how to handle Michael.
Kevin: Handle him? How? If I tell the truth, it looks like Phyllis killed the state's key witness in order to cover up the truth. If I lie, my own brother is gonna put me in a cell.
Chloe: (Sighs) I'm sorry.
Kevin: Yeah, yeah, I'm sorry, too. I never should have opened up my mouth and said anything to you.
Phyllis: Kevin. L-listen, um, when you-- when you get up on the stand...
Chloe: Um, you know what? I don't really think that I should be here for this.
Kevin: Look, Phyllis, I already know what you're gonna ask me.
Phyllis: I wasn't gonna ask you anything. I wanted to see how you--
Michael: Not another word, Kevin. Leave this witness alone.
Phyllis: (Scoffs)
Michael: I would have thought you'd learned your lesson by now.
Phyllis: What?
Adam: Last time you said you had a proposition for me, Jack, I wound up in prison.
Jack: That was a complicated situation. This is simple and totally legit.
Adam: I have a plane to catch.
Jack: I understand you refused to back Victor with your Newman shares.
Adam: I am through with Victor and his whole, uh, fan club. But if you're making a play for the company, I don't have enough shares to help you ward off an attack.
Jack: You want to sever ties? Fine. I don't blame you. But if you really want to stick it to the old man, sell his shares to me. Name your price. Give me the final bullets I need to take Victor down.
Victor: Well, we bought some additional shares at premium price.
Victoria: Really? How many?
Victor: Not enough. (Exhales slowly) This is not the first time that I'm staving off a hostile takeover of the company, and this won't be the last, either, but I'll be damned if I allow Jack Abbott... to take over this company without a fight.
Victoria: It's good to see your old fighting spirit returning, Dad. I'm gonna check back in with you later.
Victor: Thank you, my darling.
Victoria: All right. I love you.
Victor: (Grumbles) Bring it on, Jack Abbott. Bring it on.
(Knock on door)
Sharon: (Clears throat)
Tucker: Can I come in?
Sharon: I wasn't, um...
Tucker: You weren't expecting me.
Sharon: (Chuckles)
Tucker: Yeah. Well, they let me go, and now I'm in the process of clearing my name. I was hoping you could help with that.
Sharon: How?
Tucker: By going to the feds, taking back your accusations. I did go to bat for you with Victor, you know.
Sharon: Yeah, I, um... I feel really terrible about going after you like that, after you sold Beauty of Nature so that he wouldn't prosecute me.
Tucker: Well, you had no way of knowing.
Sharon: No, but that's very gracious of you to say.
Tucker: It's time for us both to move on. You do this one last favor for me, we'll call it even.
Adam: We need to get the heck out of dodge before anyone else shows up with an offer I can't refuse.
Chelsea: Are you sure you want to leave, with so much going on?
Adam: (Sighs) All the more reason to get out of here that much sooner. Last thing I need is more family showing up, making me feel all warm and fuzzy inside.
Chelsea: If only they could see how much they've hurt you.
Adam: I'll take my life over theirs any day. Only family I need is you and that little baby there.
Chelsea: (Sighs)
Ronan: So if the judge hadn't had his attack when he did--
Phyllis: Michael would have gotten the truth out of Kevin and we'd both be screwed.
Ronan: And that could still happen.
Phyllis: No, only if Kevin takes the stand again. He wasn't enjoying himself, believe me.
Ronan: Well, what's Leslie have to say about this delay?
Phyllis: She's all about damage control.
Ronan: Damage control? We can do better than that.
Phyllis: How?
Ronan: All right, we can work this through. We talk about it. We form a strategy. If there were ever two people smart enough to get themselves out of this situation, it's you and I.
Summer: I can't believe this. Here you are in front of everyone, hanging out with your stupid boyfriend!
Nick: Stop it, Summer.
Phyllis: Oh, God, Summer. Whoa, whoa, whoa, whoa, whoa, keep your voice down. Summer, keep your voice down.
Summer: I'm sorry I ever came here. Leave me alone! I never want to see you again.
Phyllis: Oh, my God.
Nick: Okay, okay.
Ronan: No, no, no, no, no, no, no. Come here. Listen, the judge could come back in at any time. You need to be here if he comes back. You cannot leave right now, okay? You can't leave now.
Nick: (Scoffs)
Fen: This is where you go to hide?
Summer: It's the perfect place. Look how long it took you to find me. Sure you don't want to run back to your folks and tell 'em where I am?
Fen: I'm sorry, but the way you've been acting, I was scared you were gonna do something crazy.
Summer: I feel like running away.
Fen: Please don't.
Summer: Hey, I know. We could go down to Chicago for awhile, have some fun. What d0o you think?
Fen: Chicago?
Summer: Yeah, you know, "The Windy City" or whatever. I bet we could get fake IDs and hit Rush Street.
Fen: What? No, no, that-- that's a terrible idea.
Summer: Why?
Fen: I'm in big-time trouble for sneaking out last night, and you're supposed to be grounded, remember?
Summer: (Scoffs) You're as lame as everyone else.
Fen: (Sighs) Oh, my God.
Chloe: Hey.
Kevin: What?
Chloe: When was the last time you ate?
Kevin: I don't know.
Chloe: Okay, so how about I go downstairs and I get you something from one of the vending machines?
Kevin: No, thank you.
Chloe: Okay, how about something to drink? How about water?
Kevin: Chloe, stop. I don't want to talk about food. I don't want to talk about the case. I don't want to talk about how late it's getting.
Chloe: Okay, so then what do you want to do? Is... God.
Daniel: Hey.
Heather: Hey. Want a water?
Daniel: I was just going to the fountain.
Heather: Don't say I never gave you anything.
Daniel: (Chuckles) Thanks. What do you make of all this?
Heather: That I'll be really glad when this day is over.
Daniel: Me, too. Yeah. Have you heard any word from Fen?
Lauren: He's still-- he's still looking for Summer.
Daniel: (Sighs) That girl sure does spend a lot of time being lost, doesn't she?
Lauren: Yeah, well, hopefully, he will find her and persuade her to go home.
Nick: Let's hope.
Phyllis: Um, how long is it gonna take the jury to connect the dots? I mean, five seconds? If--if Kevin... (Laughs) Gets back up on the stand--
Avery: Quiet, quiet. I know you feel helpless, but you cannot get wound up right now.
Leslie: You need to stay calm, Phyllis. We cannot afford an outburst. Understood?
Man: Court's back in session. Please rise.
Paul: She's gonna get off.
Chris: Why would you say that?
Paul: Because she's Phyllis. She always survives. She's got nine lives, and nine more after that. She'll never get what she deserves.
Billy: So what's new?
Victoria: Well, my father thinks that Jack is trying to make a play for Newman.
Billy: Yeah, well, I know he's dying to.
Victoria: How is it that we're full-grown adults, and yet we're still controlled by our families?
Billy: Yeah, it was romantic when we were kids, but now 's getting rather inconvenient.
Victoria: (Sighs) So what are we gonna do?
Billy: What are we gonna do? Well, I'll tell you what we're not gonna do. We're not gonna mess up this good thing we got going here.
Victoria: You do not know how relieved I am to hear you say that.
Billy: Yeah?
Victoria: Yeah.
Billy: How relieved? Uh-huh.
Tucker: Thanks for making that call to the feds for me. I appreciate it.
Sharon: Well, that was the least I could do. I'm glad everything is working out for you.
Tucker: Well, things are gonna work out for you, too, Sharon. Not sure I can say the same for Victor.
Sharon: Oh?
Tucker: Just a heads-up-- you need to be careful. If something even worse happens to the Newmans, they're gonna blame you. It could get ugly. I don't want to see you in the middle of all that. Watch your back.
Victor: I've been expecting you, Jack.
Jack: Yeah, I'll bet you have.
Victor: So what can I do for you?
Jack: Well, I thought I'd give you fair warning. I now have Adam's Newman shares in my pocket.
Victor: (Chuckles) Thank you for letting me know. That's very helpful. You ever thought of becoming a business reporter? You'd make quite a name for yourself.
Jack: Actually, the only name I care about these days is... Abbott Enterprises. Has a nice ring to it, don't you think?
Victor: Give me your best shot, Jack.
Judge Daley: I've reviewed the state's case against Phyllis Newman, and I won't waste any more of the court's time. Counsel for the defense, your motion is granted. I'm making an immediate ruling to dismiss this case.
Phyllis: (Whispers) Oh, my God.
Fen: The way Summer tore out of here, I figured I'd better call someone. I'm worried about her, Noah.
Noah: She was bad with my parents, too. Summer just needs to learn how to roll with the craziness.
Fen: That's not in her nature. I'm afraid she might do something really dangerous.
Summer: (Sobbing)
[Remembering]
Summer: Here you are in front of everyone hanging out with your stupid boyfriend!
Summer: (Sobs)
Adam: You think I'm selfish for backing Jack instead of my own family?
Chelsea: You've been wanting to distance yourself from Victor ever since he came back and totally ignored you. I'd say you're out of his orbit now. Watch out!
(Tires squealing)
Next on "The Young and the Restless"...
Chris: This case is completely legitimate.
Judge Daley: I can't wait to find out who the hell you are.
Kevin: If my job was to use my brother to crucify my best friend, I'd find a new line of work.
Chris: We're gonna make her pay, you and me--together.
