Tucker: Well, this is a nice surprise.
Ashley: Yeah. Well, I'm not staying.
Tucker: So you're taking more things... (Sighs) To the club?
Ashley: Aren't you supposed to be at your occupational therapy appointment?
Tucker: Uh, they changed the time. I just got finished.
Ashley: How did it go?
Tucker: Well, I do what they tell me, but... (Sighs) It doesn't feel like I'm making much progress.
Ashley: Oh. Well, don't get discouraged. I know it will happen for you.
Tucker: Well, hopefully, before the public finds out I can't tell the difference between a profit report and a budget plan.
Ashley: I don't blame you for being worried about that leaking.
Tucker: I'm more worried about what's happening to my company while I'm on the sidelines. God only knows what damage Katherine is doing.
Kay: Luckily, the judge agreed that Tucker wasn't ready to resume running the company, much to my son's displeasure. Have a seat.
Neil: Oh, thank you, Katherine. Uh, yeah, he's the one who gave you control in his living will.
Kay: Uh-huh, and I'm sure he's still kicking himself for it.
Neil: Mnh-mnh-mnh.
Kay: Hmm?
Neil: It does not matter. Until he's declared competent, you can do as you see fit.
Kay: Oh, I may not have that much time.
Neil: Coming back from a brain injury-- that, uh, that doesn't happen overnight.
Kay: Well, maybe not, but my son has a very strong motivation for getting well quickly. And I have to make my move on certain things while I'm still acting C.E.O.
Neil: Really? What--what things, Katherine?
Kay: (Sighs) Number one on my list is that Chancellor Industries regains control of Jabot.
Sharon: The woman who was murdered in the Town Park, I heard that she was identified as Diane Jenkins.
Sam: Were the two of you close?
Sharon: No. No. Um, truthfully, not very many people liked her. She was married to Victor twice, and she has a child with Jack.
Sam: Yeah.
Sharon: That poor boy is gonna be devastated. The news reports say that there's a lot of speculation about who killed her.
Sam: Well, there's a lot of prominent folks on the list of suspects. There's Victor, Jack Abbott, Adam. I got to be perfectly honest. I don't put it past that cat, after what he's done to you. I just don't.
Sharon: It's just-- I still find it hard to believe he could be so twisted-- to find the evidence to prove I'm innocent and then withhold it out of spite.
Sam: Well, if he thinks he's damned you to another 30 years in prison, I've done a little background check on Avery, and it's gonna take a lot more than a missing memory card to stop her from getting you out of here.
Adam: Thank you for meeting me.
Elena: It's a pleasure. I was hoping you hadn't lost my number. (Giggles)
Avery: Oh, when I said we were neighbors, I didn't realize we were practically next door.
Adam: (Sighs) Well, what a coincidence.
Avery: Mm. Oh, you must be Mrs. Newman.
Elena: Oh. (Scoffs) No, I-I'm just--
Adam: An acquaintance.
Avery: Oh, sorry.
Elena: (Laughs)
Avery: You know what they say happens when you assume. Well, I should be going.
Adam: Yes, uh, good luck on whatever case you're working on, Counselor.
Avery: Don't need luck when you've got talent. Just ask my former clients. They're all walking around free.
Elena: Talk about conceited. (Scoffs)
Adam: After you.
Elena: (Sighs) (Sighs)
Adam: (Sighs) Make yourself comfortable.
Elena: Anything to drink around here?
Adam: Um... actually, we need to talk.
Elena: If you ask me, talk's overrated. (Chuckles)
Adam: Elena, this-- this is important.
Elena: What is it?
Adam: I need you to back me up about the other night, the fact that we were together and how long we were together. You willing to do that?
(Telephone receiver hangs up)
Man: You stare at that board any longer, your head will explode.
Ronan: Every person Diane Jenkins texted the night she was murdered denies being anywhere near Town Park. The liars.
Man: Yeah, well, if everybody told the truth, we'd be unemployed.
Ronan: (Scoffs) This is true. We have decent physical evidence. We have the shoe impressions. We have the fingernail. We just can't connect any of it to the killer. That ring-- that ring, that ring. If we could find that ring, the one that made the impression on the victim's arm, I'd stop watching sports for a year.
Man: Your best guess-- who's the perp?
Ronan: (Scoffs) Diane messed with a lot of people in this town, but my best guess-- my money would be on this one right here. I think she pushed him a little too far.
Jack: (Sighs)
Woman: Here he is.
Kyle: Dad.
Jack: Hey. Hey. (Inhales sharply) Oh, God. (Inhales sharply) You have no idea how worried I was when you didn't call me back.
Kyle: But why are you here? Mom was supposed to be coming.
Jack: Sit down. Kyle, I'm afraid something terrible has happened.
Kyle: What do you mean?
Jack: There's no easy way to say this. Your mom died.
Kyle: No, no, you're lying.
Jack: No, I wish I were, Kyle.
Kyle: No!
Jack: Kyle, listen to me.
Kyle: I don't believe it.
Jack: You have to listen to me, Son.
Kyle: Oh, you're just saying that so I'll go home with you instead of her.
Jack: No, I would never do that to you. You know that.
Kyle: She left me a message saying she--she'd be here soon.
Jack: I'm so sorry.
Kyle: (Sniffles)
Jack: I'm so sorry.
Kyle: (Sniffles) Was it a car accident?
Jack: Kyle, how it happened isn't really the important thing here.
Kyle: Dad, I'm not 5 years old. Just tell me.
Jack: She was killed-- a head injury. She was struck several times. They found her in Town Park.
Kyle: Who would do something like that? How could they? She--she was supposed to come back for me.
Jack: I'm sure she meant to.
Kyle: I'm never gonna see her again.
Jack: Kyle. (Inhales sharply)
Elena: So the detective thinks you were someplace you weren't.
Adam: Right, right. Look, so if he asks, you just tell him the truth-- we were downstairs having drinks, and afterwards, we came up here and... you know what? Why don't you just follow my lead?
Elena: Sure, Baby. I can do that.
Adam: Thanks, Elena.
(Knock on door)
Adam: You know what? Why don't you go powder your nose? I'm gonna find out who this is, and don't come out unless I call you out, okay?
(Persistent knocking on door)
Adam: Well, look at this. Detective Malloy. I had a hunch you'd be back.
Kay: Now as acting C.E.O. of McCall, I can legally authorize the sale of Jabot to Chancellor.
Neil: Well, you know that Tucker will fight to get it overturned.
Kay: Well, that doesn't mean he will win.
Neil: Katherine... (Clears throat) It'll look like that you got him declared incompetent in order to push the Jabot deal through.
Kay: Well, I'm taking steps to protect myself.
Neil: What steps?
Kay: I'm going to sell Jabot to Chancellor for double the market value.
Neil: Double?
Kay: Well, it's a very steep price to pay, but, uh, you know, considering today's market, it's an incredible deal for McCall.
Neil: It doesn't matter how incredible it is. It--it-- Tucker is gonna freak out. He's gonna go crazy.
Ashley: I know. I can't believe it's happening, either. Of course I'll call you if I hear anything. Did you want me to come over? It's not a problem at all. I'll be there as soon as I can. Okay, bye.
Tucker: Is it bad news?
Ashley: Oh, it doesn't concern you.
Tucker: (Sighs)
Ashley: (Stammers) You can't do that.
Tucker: What?
Ashley: Look all hurt because I'm not confiding in you when your lying is the reason why we're having these problems.
Tucker: (Sighs) Did, um, did you tell Abby about the...
Ashley: About the... you're having a hard time getting the words out?
Tucker: Well, yeah. Saying something I know is gonna hurt you-- I don't want to do that.
Ashley: In answer to your question, no, I haven't, but I'm planning on talking to her very soon.
Tucker: I miss you.
Ashley: Did you miss me when you slept with Diane?
Tucker: (Sighs)
Ashley: Take care of yourself.
Tucker: Oh, let me help you with--
Ashley: No, I'm okay.
(Door closes)
Tucker: Is that right? (Sighs) Deal with this clown now. (Sighs) (Sighs) Yeah, listen, I need to see you. No, right now. My place.
Victoria: You know, Jill was here looking for Billy. And when she finds out that he's gone... you know what? I don't understand how I'm supposed to... how I'm supposed to make all these people understand what I don't understand myself. (Sighs)
Victor: But, Sweetheart, what is there to understand? He's going back to his old ways-- boozing, gambling, and a smorgasbord of women.
Victoria: Dad, would you please stop? Just stop, okay? I don't want to hear it.
Victor: But you need to hear it, Sweetheart. He's even asking you to break the news to his family. He's a coward.
Ronan: So the night that Diane Jenkins was murdered, you were in the bar having cocktails.
Adam: (Sniffs) We've been over this already.
Ronan: Yeah, I know what you told me, but then I called that bartender downtown for questioning, and he couldn't verify your timeline.
Adam: Well, you could always ask Abby. She was there.
Ronan: So that's why you asked her to provide you with an alibi?
Adam: Who told you that?
Ronan: Is it true?
Adam: She misunderstood. See, I don't know if you know this about my sister, but this is putting it nicely-- she's a bit flaky.
Ronan: So then if your sister says that she doesn't remember seeing you?
Adam: I'd blame it on the alcohol. She was bathing in it.
Ronan: Okay, that's one explanation.
Adam: My family despises me, Ronan. You know that. They would much rather eat dirt... (Sighs) Then vouch for me. As far as the bartender goes, he was either overworked or he is a complete moron.
Ronan: Mm-hmm. Or the bottom line is, you don't have an alibi.
Adam: (Clicks lips) Oh, but I do. Elena?
Ronan: (Chuckles) I'm sorry. My apologies. I didn't realize you had company.
Adam: Mm-hmm. Elena, this is Detective Malloy. He has some questions about the night that we were together. She'll vouch for me.
Sharon: Thanks.
Sam: For what?
Sharon: For cheering me up. It seems to be your specialty.
Sam: Well, we all have to have a talent, right?
Sharon: And another thing that lifted my spirits...
Sam: What's that?
Sharon: I got a letter yesterday from Piper with the cutest picture of her and Fanny.
Sam: I didn't put her up to it, if that's what you're thinking.
Sharon: She said that you told her I don't deserve to be in here.
Sam: Well, you don't.
Sharon: She also mentioned what a good friend I was to her when I lived on your farm.
Sam: See? I'm not the only one with a knack for making people feel good. You have a lovely smile, you know that? I almost forgot about that.
Sharon: I don't know how you do it, Sam.
Sam: Do what?
Sharon: Well, I'm locked up in this horrible place, and somehow, you keep finding ways to make it bearable for me.
Sam: Anytime.
Sharon: Thank you. I-I-I don't know how I could get through this without you.
Victor: I'm sorry if you think I'm too blunt, okay?
Victoria: You know what, Dad? You've made it pretty clear how you feel about my husband. You've wanted him out of my life since the minute we were a couple.
Victor: But, Sweetheart, there's a reason. I knew--I feared that he would break your heart, and that's exactly what he has done.
Victoria: Well, there's a lot to Billy that you don't realize...
Victor: (Inhales sharply)
Victoria: Because you've never given him a chance, Dad.
Victor: After that phone call just now, how can you stand here and defend him?
Victoria: I'm not defending him, okay? I'm not. I just don't need you trashing him right now.
(Knock on door)
Victor: Okay, I'm sorry.
Victoria: Fine.
Victoria: Oh, hey, Ashley. Come--come on in.
Ashley: Am I interrupting?
Victor: Hi, Ashley.
Victoria: No.
Ashley: Hi, Victor. Uh, anyway, I spoke with Traci, and she hasn't heard from Billy.
Victoria: What about Jack?
Ashley: Uh, Jack's with Kyle, and they're on their way back from Switzerland, so I figured he had his hands full.
Victor: So Jack found Kyle?
Woman: Your son's things have been brought downstairs.
Jack: I appreciate that.
Woman: Again, Mr. Abbott, my deepest condolences.
Jack: Thank you. (Sighs) Jack: What do you say, Buddy? You ready to go home?
Victor: Did Jack say how Kyle was doing?
Ashley: No. I didn't speak to him. He just left a message saying that he was gonna be back tonight with him.
Victor: Ah.
Ashley: And I am so sorry. Is there anything I can do?
Victor: I'm glad you're here, because I think Victoria needs your support now that her mother is gone.
Victoria: Dad, do you mind? I'd just like to--to speak to Ashley in private.
Victor: You may not believe me, but I truly wish that Billy had been the man that you wanted him to be. All I ever wanted was your happiness, okay? Bye. Bye, Ashley.
(Door opens)
(Door closes)
Ashley: Was your dad here when you found out about Billy?
Victoria: Yeah. Of course he had to rub it in, how he's been right about Billy all along.
Ashley: Do you really want to talk, or was that just an excuse to get rid of your dad? Because if you want to be alone, I get it.
Victoria: I really don't know what I want right now. I just... I can't believe that he's gone.
Ronan: So you're certain about the time, Ms. Strauss?
Elena: Yes.
Adam: What part of "We were together all night" don't you understand, Ronan?
Ronan: No, I got it. So when you finished your cocktails, did you both come up here together?
Adam: Yes, and we were here until the morning.
Ronan: Well, I certainly hope that's what the security footage from the corridor here shows.
Adam: Well, get ready to be happy, because it will.
Ronan: (Chuckles) Did Mr. Newman here mention that he's the lead suspect in a brutal homicide investigation?
Elena: The woman from Town Park?
Ronan: Oh. Oh, he didn't tell you that?
Adam: (Sighs)
Elena: (Sighs)
Adam: Funny. That's because there is nothing to tell. I didn't do it. "Inspector Gadget" here would like to pin this whole thing on me. That way, he could tie a nice pretty little bow around this investigation without actually having to do any real investigating.
Ronan: Right. Right. You know, you have been more than helpful, Ms. Strauss. But now I need to talk to Mr. Adam alone for a while. If I have any questions, I'll call you, though, okay? Thank you.
Elena: Sure.
Ronan: Okay. Wow. She left in a hurry. (Scoffs)
Adam: You know, you're getting on my nerves, Ronan.
Ronan: Why, Buddy? I'm just doing my job.
Adam: You should get a dictionary and look up the difference between "Investigating" and "Persecuting."
Ronan: I'll do that as soon as you stop jerking me around.
Tucker: You signed a confidentiality agreement. Everyone at your facility did.
Man: So?
Tucker: I have a spy on the inside.
Man: Well, I didn't do anything.
Tucker: You call trying to access my file by logging on to someone else's computer "Nothing"?
Man: (Scoffs) Whoever told you that is full of it.
Tucker: Fortunately, you were too stupid to pull it off.
Man: Hey!
Tucker: You thought you could make a fast buck by selling my private info to the tabloids. But you blew it. I already talked to your boss. You're fired.
Man: What--you can't do that!
Tucker: It's done! And let me tell you something-- if you say anything to the media, if you so much as speak my name in public, I'll not only sue you, I'll make it my personal mission to destroy your life. Now get out. (Sighs)
Kay: Tucker should have never had Jabot in the first place. He stole it from me, remember?
Neil: Remember? By--by blackmailing-- yeah, how could I forget?
Kay: Well, how can he fault me for my tactics? I stole a page out of his book.
Neil: Somehow, I don't think he's gonna see it that way.
Kay: Well, ask me if I care.
Neil: (Chuckles) I know you don't care, Katherine. Uh, you know, if it were any other company in the McCall conglomerate... but Jabot is special to him because of Ash.
Kay: And I'm betting that he cares more for Ashley than he does for Jabot.
Neil: Am I missing something?
Kay: I'm trying to have his marriage annulled.
Neil: You're trying to have-- on--on--on what grounds?
Kay: Because he wasn't sound of mind when he--the ceremony took place.
Neil: (Sighs) I never thought he was right for Ash. Well, he's angry now--I-- why--why--why are you trying to make him even more angry?
Kay: Uh--
Neil: Um, okay... unless it's a smoke screen.
Kay: I'm going to cover myself. I'm going to give Tucker notice of my plans for Jabot.
Neil: And how are you gonna do that? You--you--are you gonna write him a letter in invisible ink?
Kay: Oh, come on. It's important that, in the future, he won't be able to say that I didn't inform him.
Neil: So you're counting on him being so busy fighting the annulment that he's not gonna see the Jabot deal coming.
Kay: At least not in time to stop it.
Avery: Well, I managed to bump into Adam a couple of times. Thank you. (Sighs)
Sam: And how did you do that?
Avery: Well, two strangers strike up a conversation in a bar. Then today, I bumped into him outside his hotel room.
Sharon: What were you doing there?
Avery: I'm staying a couple doors down from him.
Sharon: Oh, okay. Well, look, I know you're-- you're trying to get a feel for him...
Avery: Mm-hmm.
Sharon: But Adam is very sharp. A few too many accidental run-ins, and he will begin to suspect something.
Avery: Oh, he already knows who I am.
Sharon: Oh. Oh, no.
Sam: Well, so much for getting him to get his guard down, huh?
Avery: No, it's fine. I-I knew he'd figure it out. I like the idea of him being unnerved by having me so close.
Sam: Well, you have got guts, I'll--I'll tell you that much.
Avery: Well, you have to when you fight for the underdog, especially considering what we're up against.
Sharon: The fact that Judge Salazar has never had a case overturned on appeal.
Avery: We need to be clever, creative, come up with things that your previous attorneys didn't.
Sam: What about Skye's body?
Avery: Or lack thereof.
Sam: Well, it seems to me you shouldn't be able to convict somebody of murder if you don't have enough corpse, right?
Avery: You would think so, wouldn't you? You'd think that justice would be clear-cut and fair, that someone with a modicum of intelligence... (Sighs) Would see a situation for what it is and rule on it accordingly. But what looks incontrovertible to you looks completely different to the next guy.
Sharon: So there's no hope.
Avery: Well, that's what they said when I was born eight weeks early-- jaundice, sepsis, apnea... the list goes on. I don't give up.
Sam: Good. See, I like that. So where do we start? What do we do? We look for the memory card and the camera?
Avery: Mm-hmm.
Sam: We scour the transcripts for mistakes? We--we--
Avery: Yeah, we do all that and more. I don't plan on getting much sleep.
Sharon: Won't your other clients demand some of your attention?
Avery: I don't have any other clients.
Sharon: Really, an attorney with your reputation?
Avery: When Victor hired me, it was with the understanding that I was exclusive to your case, so you have my full attention, as well as my team's.
Sharon: Your team?
Avery: Mm-hmm.
Sam: I've read up on them. I didn't get the chance to tell you, but they are-- they are pretty amazing.
Avery: Thank you. They will throw themselves into this like nothing you've ever seen. If there's something that can win your appeal, they'll find it.
Ronan: I checked your credit card from the night of the murder.
Adam: (Sighs) Okay. Why?
Ronan: I wanted to see when your first drink was rung up. It seems you and your new friend there got to the bar a little bit later than you claim, which means to me that you had enough time to get to town park, kill Diane, and then make it back to the bar.
Adam: You should write mystery novels. They're fiction, too.
Ronan: Explain the discrepancy.
Adam: I bought the first couple of rounds in cash.
Ronan: Come on. You can do better than that.
Adam: I've had enough of your questions. Why don't you see yourself out?
Ronan: Sure. I'm on my way. But first, you don't mind if I search your hotel suite, do you?
Adam: Hell, yes, I mind.
Ronan: But if you have nothing to hide, what's the problem?
Adam: The problem is I don't like your attitude.
Ronan: Would it help if I said "Please"?
Adam: Mm... no. See, that's the great thing about the fourth amendment. You can't snoop around here unless you have a warrant.
Ronan: Good thing I've got one.
Victor: Michael, do you know when, uh, Jack and Kyle's flight arrives? All right. Uh, I need to see you later. Yes, I need to see you. Right.
Avery: And that's how I came to work for the Center for Unjust Convictions.
Sam: It's based out of Northwestern University’s law school.
Avery: Mm-hmm. The team I was telling you about is made up of students.
Sharon: Students?
Avery: Mm-hmm. They're members of the innocence foundation, and they are just the most outstanding group of men and women. Some are studying law, some journalism. You won't find anyone who will work harder for you.
Sharon: Okay. Um, but if they've never had a real job...
Avery: Then they aren't trying to win to grab headlines or justify huge salaries. They do this because they're passionate, Sharon. You won't believe what a difference it makes.
Ashley: For what it's worth, Billy's made a mess of his life before, and he always comes back after he pulls it together. I just wish things hadn't gotten so far, you know? I--you guys could have come back together and made it work.
Victoria: You know, we came close.
Ashley: You did? When was that?
Victoria: Well, right before he left. I, uh, I told him how much I needed him, and we made love. It was really nice. It was kind of like old times. And I was thinking... that maybe... well, anyway, I-I got up to go get some coffee, and when I came back, he was gone.
Ashley: That's bizarre. Did you try calling him?
Victoria: Yes, I did, Ashley. I called him numerous times. You think that I would get it through my head, because he wasn't answering the phone. I mean, God, he has to leave the damn country for me to understand that it's over between us.
Ashley: I know how hard it can be when you expect more than somebody's capable of giving. (Sighs)
Victoria: I know that he loves me. And you know, as badly as he's hurt me, I... (Voice breaking) I still love him.
Ashley: Sometimes it's not enough, huh?
Victoria: (Sniffles)
Tucker: Oh. What the hell do you want?
Kay: I'm here to talk.
Tucker: You want to talk? You want to talk to me? I thought I was so mentally challenged, I don't even know who I want to be married to.
Kay: Tucker, you're only acting like this because you know I'm right.
Tucker: You're a meddling egomaniac who wants to control me.
Kay: Please, please, please, please don't be melodramatic. We both know you're not back to your normal self yet. So just calm down. We have some business to discuss.
Tucker: Come on, Katherine. What's this about, really?
Kay: Uh, here are various deals that, uh, I've been working on, and I'd like you to sign off on them.
Tucker: Is this another trick...
Kay: (Sighs)
Tucker: Like the one you used in front of that judge?
Kay: Gesture of good will-- my intent to make you part of the process.
Tucker: A damn small part.
Kay: Tucker, listen to me. The court made it very clear. I am in charge. Now you can either fight me or you can cooperate.
Tucker: Okay, I'll tell you what-- I'll look over these files. I'll sign what I approve of. And if you're hoping I'm gonna screw up, you're gonna be very disappointed.
Victoria: You know, it's really nice to talk to somebody else who cares about Billy.
Ashley: Oh, anytime, Vicki, you know that.
Victoria: Thank you.
(Cell phone alert chimes)
Ashley: Excuse me. Oh, I'm getting an e-mail.
Victoria: Oh.
Ashley: I don't recognize that address. It's from Billy. He sent one to Jack and Traci, too.
Victoria: Really?
Ashley: Mm-hmm.
Victoria: What does it say?
Ashley: "Hey, Guys. I'm fine. Back in Asia. Don't worry. It's all good."
Victoria: It's all good?
Ashley: You know that's a lie. His life is a mess right now.
Victoria: So he e-mails you and Jack and Traci. The guy walks out on me, and he can't be bothered to put me on the list? That's great. This is just great. This is how my marriage is ending. Nice.
Victoria: (Sighs)
Sharon: I don't mean to sound ungrateful, but--
Avery: Don't let the fact that I'm working with college students frighten you.
Sam: The group's track record's pretty damn unbelievable.
Sharon: Really?
Avery: Yes. My team and I have gotten 23 men and women exonerated in the state of Illinois.
Sam: That was before the death penalty was abolished there...
Avery: Yeah.
Sam: So some of these guys were actually on death row.
Avery: Yeah, they were condemned to a life in prison or worse for crimes they didn't commit. We gave them their lives back. Let us try to the do the same for you.
Ronan: Sure am sorry for the inconvenience. You know how it is. A woman was murdered. It's just my job to figure out who did it.
Adam: Yep, while what you should be doing is be out there hunting down the real killer instead of, uh, ransacking my hotel suite.
Man: Uh, Detective.
Ronan: Why don't you just sit tight there?
Ronan: (Chuckles) Harvard, huh? All right, good work. Get this down to forensics immediately. Verify for me if that was the one that left the imprint on Diane Jenkins's arm.
Man: Got it.
Jack: Can I get you something to eat? How about a glass of milk? Can I get you anything at all?
Kyle: Yeah. My mom.
Jack: Look, I know you didn't want to talk about it on the plane.
Kyle: Talking won't bring her back.
Jack: Try to remember something, okay?
Kyle: Okay, what? (Sniffles)
Jack: Your mother loved you more than anything in the world. You were her whole life, the best part of her, she used to say. And there is nothing she wouldn't have done for you.
(Doorbell rings)
