Episode # 9692 ~ Chloe's Testimony Hurts Billy's Custody Case

Provided By Suzanne
Proofread By Emma

Rafe: Come on, Man. Where are you, Dude? Call me as soon as you get this.

Victoria: Hi.

Rafe: You haven't seen Billy by any chance, have you?

Victoria: You're, um, you're asking the wrong person.

Rafe: I just wanted to check in with him before getting to the courthouse.

Victoria: Oh, the custody hearing.

Rafe: Yeah.

Victoria: I-I didn't realize that it was happening so soon.

Rafe: Between us, I'm, uh, I'm a little concerned that he's in no condition to face a judge today.

Victoria: Um, I'm sorry, Rafe. I wish I could be more help, but I'm not in Billy's orbit right now.

Chloe: So just take good care of her, okay, Mom?

Esther: Okay, Honey, don't worry. Everything's gonna be okay.

Chloe: Okay. (Sighs)

Esther: Bye-bye, Kevin.

Kevin: Bye, Esther. Bye, Delia.

Chloe: (Sighs)

Kevin: So I hope you don't take this the wrong way--

Chloe: I know. I know. You think that I'm wrong by filing for full custody, but you know what? I'm the mother, and I know what's best. So I just don't want to hear all that noise about Billy and what a great father he is, okay? Not today. Especially not today.

Kevin: I was gonna say I made you a decaf, which seems to be the right choice.

Chloe: Oh. Oops. Sorry. I'm really nervous today. I don't know why. The last few times I saw Billy, he was a poster boy for "Hobo nation." He's probably not even gonna show up.

(Cell phone rings continually)

Noah: Why shouldn't I leave?

Eden: Have you seen your mom yet?

Noah: No, and I'm not going to.

Eden: Why not?

Noah: (Scoffs) 'Cause yesterday, we stood in a park, and we talked about how much she meant to us and how much we missed her, and then we scattered her ashes, only they weren't her ashes, so how messed up is that, and how messed up is my mom for letting us think that?

Eden: Your mom is alive, Noah. That's what matters.

Noah: (Sighs)

Sharon: I'm really embarrassed to have you see me like this. I-I just never wanted you to know about this part of my life.

Sharon: Victor, I'm sorry.

Victor: We're gonna discuss what you did later, all right? Now let's figure out how to get you out of here. And may I ask, who are you?

[Adam remembering]

Adam: It's ours, and no one can take that away from us.

Sharon: Are you sure about that? Because I don't want this to end.

(Knock on door)

Diane: Bad time?

Adam: My back is already full of cutlery, Diane, so if that's why you're here, you can just turn around and go.

(Knock on door)

Billy: I'm comin'. (Sighs)

Victoria: Hi.

Billy: Hi. Uh, the custody hearing is today, so...

Victoria: Yeah, I heard. Rafe was looking for you.

Billy: Yeah, I guess I should call him, let him know--

Victoria: Know that you're not curled up on the couch with a beer in your hand? I'm sure he would very much appreciate that.

Billy: Yeah.

Victoria: Okay, well, you look good. (Sighs)

Billy: Yeah.

Victoria: And you're off to a good start, 'cause you're wearing one of my favorite suits.

Billy: (Chuckles) I'm scared, Vick. Chloe's lawyer, she's got, uh, a lot of material on me. I was thinkin' maybe a little liquid courage or--

Victoria: No.

Billy: (Clears throat)

Victoria: No, you don't need a drink to give you courage. You're Billy Abbott. You just flash your smile and you speak from your heart and people will listen to you, especially when you're talking about your little girl. You just let the judge know how much you love her, and you won't lose.

Billy: (Clicks lips) Well, I don't know if that'll be enough, but, um... (Clears throat) (Sighs) All right, uh...

Victoria: (Clears throat)

Billy: I've gotta go. You sure I'm snazzy enough for court?

Victoria: Snazzy, yes. Very snazzy. A little scruffy.

Billy: Yeah. Well, um, I-I'm sure it'll be okay.

Victoria: Okay, listen. No field trips to Jimmy's, okay? Straight to court.

Billy: Thank you.

Victoria: Give 'em hell.

Diane: I assume Genoa City's latest Lazarus is at least partially responsible for this foul mood. Well, I thought you'd be ecstatic about Sharon's return.

Adam: Me, too. But while I was grieving for her and dedicating my life to proving her innocence, I seemed to be the furthest thing from her mind. She was off spending time with someone. What a relief being here with someone I can't trust. At least I know what I'm getting.

Diane: Well, you can trust that we both want Victor to pay for making our lives miserable, right?

Adam: And I've decided that's a flimsy concept to build a relationship on, so this partnership is over. Get out.

Diane: Come on, Adam. We work well together. Why don't we go have a drink, huh? And after you've cooled off, we can solidify plans to take Victor down.

Adam: You want to know what my new motto is? "Do unto others before they do unto you." So unless you want me to do unto you, you best leave--now.

Diane: (Scoffs) (Sighs) (Clears throat) (Clears throat) (Quietly) Leslie, it's Diane. Have you spoken to the D.A. yet? I need for you to call him immediately. Time is of the essence here, and if they want to make a deal with me to turn state's evidence on Adam, it's gotta be today.

Sharon: Victor, this is Sam Gibson. He, uh, he took me in when I had nowhere else to go. Sam, this is Victor. He's... my friend...

Victor: Mm-hmm.

Sharon: And my ex-father-in-law.

Sam: Well, uh, I gotta say, it's a little difficult to visualize the same woman that's muckin' out stables with me in my barn runnin' in the same circles as you, Mr. Newman. I, uh, I'm very aware of your business acumen, Sir.

Victor: You're being treated well?

Sharon: Sam, can you just give us a few minutes, please?

Sam: Yeah. Yeah, of course.

Spencer: Officer Reynolds will escort you to your cell.

Sharon: Um, can I just have five more minutes please?

Spencer: You may not.

Sam: It's gonna be all right, Sheri. It's gonna be fine.

Leslie: She should be able to have visitors shortly.

Victor: What are you after?

Chloe: (Sighs) I told you he wouldn't show.

Judge: Mr. Torres?

Rafe: I apologize for the delay, your honor. My client will be here momen-- momentarily.

Judge: This isn't the only case on the docket. I'm inclined to save the court's time and rule in Ms. Mitchell's favor.

(Door opens)

Billy: My apologies, judge. I am sorry.

Judge: Let's get started.

Billy: (Sighs)

Rafe: You better have a good reason for being late, Buddy.

Billy: Hey, look, I'm here, okay? I had to get my game face on. Let's go.

Rafe: All right.

Kevin: So what's the word? You're not gonna be staying with Mikey and Lauren?

Eden: Oh, I love 'em to pieces, but they still see me as the naive girl who just got off the bus from the ashram, not the mature young lady who wants to throw wild parties and have boys over. I'm kidding, Kevin.

Kevin: That's funny. (Laughs) Hey, why don't you crash at Heather's? She's stuck on a case in New York. She's looking for someone to sublet.

Eden: Oh, well, that's a nice offer, but--

Kevin: Well, think about it. It's close enough to Mikey and Lauren's to raid the fridge. I've got a great DVD collection.

Eden: (Inhales sharply) I don't know, Kev.

Kevin: Something else is bothering you. Could it be, I don't know, where Noah's gonna be staying?

Eden: We're not together anymore.

Kevin: Well, that doesn't mean that you don't care. What happened in Paris?

Eden: Stuff happens. We just drifted apart.

Spencer: I'm getting tired of our secret meetings, Ms. Jenkins.

Diane: Well, like I told you before, I can't be seen at your office.

Leslie: Have you contacted the S.E.C. on behalf of my client?

Spencer: As you are well aware, I've been busy with other matters, plus I wasn't entirely convinced that your client's claims were on the up-and-up.

Diane: I do have evidence that'll pin the Newman I.P.O. fraud on Adam.

Spencer: But you're not gonna tell me what it is, are you?

Diane: Not until I know I'm safe. I've been double-crossed one too many times in my life.

Spencer: You're gonna have to take a leap of faith, Ms. Jenkins, or there's not gonna be a deal.

Sam: I'm not after anything, Mr. Newman, and I certainly don't appreciate the implication.

Victor: You wouldn't be the first opportunist to come sniffing around my family.

Sam: I think that's where you're wrong, Sir. I didn't go sniff around anybody's family.

Victor: Mm-hmm.

Sam: So maybe the next time, you'll want to provide yourself with a story in its entirety before you go accusing people of sordid behavior.

Victor: So go ahead and tell me.

Sam: (Sighs) Sir, she just showed up in my barn one day. That's how I met her, and I-I-I-I'd like to think that my time with her, I-- I healed Sheri a bit. That's what she claimed she went by. She was in a bad place emotionally when she showed up. I mean, she could hardly muster a smile. She wasn't very forthcoming with the details, so I didn't know anything about her life in this town.

Victor: Mm-hmm.

Sam: But I fell for the woman, Sir. I fell for the woman that I worked side-by-side with on my ranch.

Victor: Mm-hmm.

Sam: And every day that she stayed there, well, that... was another good day for me...

Victor: Mm-hmm.

Sam: 'Cause quite frankly, I don't give a damn who she knows, even if it is Victor Newman. I just--I just don't.

Victor: That's a hell of a story.

(Cell phone rings)

Sam: Just pardon me, Sir. One second.

Victor: Mm-hmm.

(Cell phone rings)

(Ring)

Adam: Hello?

Sharon: Adam, it's me.

Adam: What?

Sharon: You know, the one phone call that I'm allowed to make-- I made it to you. That should tell you something. I need to talk to you.

Adam: So talk.

Sharon: (Sighs) You have to believe me. I never thought I would be back in Genoa City ever again.

Adam: (Sighs)

Sharon: The way you're feeling about me now, that's the reason I had to stay away.

Woman: Time's up.

Sharon: (Sighs) Adam, please come and see me. We need more time to talk about this, and I know that if I could just look you in the eye and explain everything that you'll understand.

Adam: Let me find out what visiting hours are. I'll see what I can do.

Sharon: (Gasps) Noah?

Woman: No physical contact.

Noah: (Sighs)

Sharon: (Sighs)

Noah: (Sighs)

Landon: Please state your name.

Chloe: Chloe Mitchell.

Landon: And you are Cordelia Abbott's mother, correct?

Chloe: Yes, she's my little angel.

Landon: Are you currently employed?

Chloe: Yes, I work at "Restless Style." I am a fashion editor, a very successful one, too. And, um, well, being a single mother is not easy, but I make sure that my work does not interfere with my responsibilities to my daughter. Yes, there are times that I have to work late or travel or be away from my little girl, but, um, I live at the Chancellor estate, and I have 24-hour support. My mother--who--Esther, um, she's been a valued employee for many years, and she lives there, as well as Jill Abbott, Delia's other grandmother. And then I have, um, Katherine Chancellor, who happens to be my godmother, and she just adores Delia and watches her whenever I need her to. But, um, I-I have them there to help me out whenever I need them, but it's never too often. Pursuing custody is not about cutting Delia's father out of her life. I want her to have a loving, protective, responsible father, and lately, those are not words that can describe Billy Abbott's behavior. Well, the day that we were married... (Sighs) I knew the marriage was doomed. It ended before it ever started. My ex-husband was not willing to commit. No, I don't think that he's learned his lesson. His current marriage is on the rocks because of poor choices that he's made, and that just proves that Delia is not a priority. Why shouldn't my daughter be with her father? Because he drinks. He gambles. He's currently unemployed, and he's been involved with criminal activity recently, so...

Landon: We'll get the details of the criminal activity later. Is there anything else you'd like to say?

Chloe: I love my daughter with all of my heart. She's the reason why I wake up in the morning with a smile on my face. The fact that I get to... hug and kiss her and answer her questions and tuck her in at night, read her bedtime stories, all of the wonderful things about being a mother-- I am reminded how precious and special my daughter is, and how I would never, ever let anything mess that up.

Landon: No further questions.

Billy: No bloodshed.

Rafe: Are you kidding me?

Billy: Look, Man, after this is over, we still have to raise our daughter together. We have enough issues. I don't want this to be another one.

Rafe: If I don't challenge her testimony, you're gonna lose the case.

Victoria: Well, hey.

Esther: (Chuckles) Ohh.

Victoria: Hi, Miss Delia. How are you this morning?

Esther: Well, she's enjoying her walk through the park, aren't you, Doll? Say hello to Victoria, Sweetie.

Delia: Daddy.

Esther: (Gasps) Oh. I guess she's used to seeing you and Billy together.

Victoria: Oh, yeah, yeah. I know. She adores her daddy. Speaking of which, I assume you know where daddy is this morning. Listen, after everything that we've been through with Lucy, I'm really having a hard time believing that Chloe would do this to Billy, and I was thinking that maybe you could talk to her and, you know, get her to back down and drop the case.

Esther: Look, Chloe is a great mom. She knows what's best for Delia. I-I'm--I'm really sorry. I-I just can't meddle.

Sharon: (Sighs) That look on your face the last time you came to see me in jail... it was heartbreaking. You didn't even turn around when you told me you were done with me. And to think that I was causing you that much pain-- Noah, that's why I thought that you and Faith and your dad, everyone would be better off without me. Can you understand that?

Noah: You know, I thought when I saw you, all I'd want to do is rip into you for what you did to us. You know, who am I to judge you? 'Cause in a weird way, I'm... (Sighs) I'm kind of guilty for doing the same thing-- running away when everyone needs me. I wasn't there when Abby needed help or--or when Grandma trashed her sobriety. And I wasn't there for you. Okay? But I'm here now. And no matter how hard it might be, I'm gonna stay.

Sharon: Even if it means I'm locked up for years?

Woman: Visit's over. Someone else is here to see you.

Noah: (Sighs) Keep your head up, Mom, okay? You're not gonna go to jail. Adam never gave up looking for evidence to clear your name, and he thinks he found it. It'll prove that Skye's death was an accident.

Billy: No below-the-belt shots.

Rafe: Ms. Mitchell, you spoke of my client's criminal activity. Weren't you recently arrested? Twice?

Chloe: Yes.

Rafe: The first arrest was for bookmaking. The second arrest was for burglary into an apartment located on my client's property. Correct?

Chloe: I was not charged for either.

Rafe: Isn't it true that you weren't charged because my client didn't think it would be good for his daughter's mother to end up in jail?

Chloe: I-I can testify-- and please, let this be on the record-- that I have no idea what Billy's thinking most of the time.

Rafe: Despite all your past transgressions, do you consider yourself to be a good mother?

Chloe: Yes, a very good mother.

Rafe: So even though you've been painting this incredibly grim portrait of my client's past, the court should keep in mind that people can make mistakes and still be a good parent. No further questions.

Man: ...And nothing but the truth?

Billy: I do. (Sighs)

Rafe: Please state your name for the record.

Billy: William Foster Abbott.

Rafe: Mr. Abbott, tell us about your relationship with your daughter.

Billy: DeeDee-- that's what I call her. She's got me wrapped around her little finger, and there's nothing in this world I wouldn't do for her.

Diane: The day of the I.P.O., when news broke about Victor's stroke and his death, the primary evidence released to the media was a video of an ambulance leaving the ranch. I happen to know who shot that video, and that person is willing to give me whatever I need to connect Adam to the footage.

Leslie: Diane's testimony and the source's evidence should be enough to put Adam away.

Spencer: I need to interview the source myself.

Leslie: Well, before Diane reveals the identity, she's gonna need some assurance.

Diane: I've acted on good faith, Mr. Walsh. Now it's your turn. You deliver me the deal. I'll give you the name.

Leslie: Come on, Spencer. Diane's stickin' her neck out here.

Spencer: I'll see what I can do.

Diane: Thank you.

Victor: So you're here to see Sharon?

Adam: And you're here to tell me not to.

Victor: Mm-hmm.

Adam: Don't you ever get tired of being so hypocritical, Dad? You fancy yourself as the reason that Sharon is protected-- you're her savior. Yet she's here behind those jail bars because of you.

Victor: You took gross advantage of her when she was most vulnerable. She certainly deserves someone far better than you.

Adam: And yet here I am, standing right here. She begged me to come see her, and I am so looking forward to the day that she's out of here and I can be with her.

Sam: You've got a suspicious friend in Victor Newman. The guy actually questioned my motives where you're concerned.

Sharon: He's like that with a lot of people.

Sam: I guess it's better to have him on your side than not, huh?

Sharon: I thought that he would be pretty mad at me like a lot of other people are, but he's been very supportive, as was my son, which was a wonderful surprise.

Sam: You have a son?

Sharon: Yeah, Noah. And I have a daughter, Faith.

Sam: You're facin' a lot of trouble here, so I don't want to upset you, but there's a lot of things I gotta know.

Sharon: Okay, all right. Look, um, ask me anything.

Sam: Is this what you do? Is it you just--you just turn and you run away from the people that care about you when the goin' gets rough? Is that just--just-- just natural for you? Is that what you're gonna do to me? To Piper? You just gonna take off in the middle of the night, no regard for our feelings?

Sharon: I thought I could just run away from my past and start a new life, but I guess I knew deep down that that would end one day. It would all fall apart, and this is no excuse, but I-I tried to keep my distance from you. Remember? One of the first things I said to you was that I'm no one from nowhere.

Sam: And I--yeah. I remember you said that, Sheri, but eventually, you let me in.

Sharon: I don't want to cause anyone any pain. I don't want to cause you any pain. That's why I think that you should just go back to the ranch and forget all about me.

Sam: That's not gonna happen, Sheri.

Sharon: Please. If you stay, I will be responsible for taking you away from everything that you love. Guard?

Sam: Wait, Sheri. What are you doin'? We're not done here. I'm not ready to leave, thank you.

Sharon: Mr. Gibson is leaving. Just walk through the door and don't look back.

Sam: (Sighs) As soon as I can wrap my head around what's happened, then, uh, I'll decide whether I stay or go.

Sharon: Adam, I'm so glad you came. There's just--there's so much that I want to explain to you, starting with Sam. Look, I know that that must have been a really big shock to you. When you left without a word, I wanted to run after you.

Adam: Well... I left because... seeing you alive and well-- it was a bit overwhelming. I didn't know how to deal. And, uh, that gentleman... Sam? I... I get that you felt like you needed someone, and that you felt alone. I'm sorry that it wasn't me.

Sharon: (Sighs)

Adam: Sharon, you know that you could have come to me and I would have helped you. I would have done anything for you.

Sharon: I know. I know that, Adam. That's why I almost ran to you when I saw you at the festival.

Adam: The festival?

Sharon: Yeah, in San Pueblo. I saw you there.

Noah: You were right about going to see my mom.

Eden: Well, everyone needs a kick in the butt sometimes.

Noah: So... (Sighs) How's the apartment hunt going?

Eden: Uh, temporarily suspended. Kevin asked me to move in across the hall from him, but I'm still thinking it over. What about you? You figure out what you're gonna do?

Noah: I don't know for sure.

(Footsteps approach)

Kevin: So, Eden, you gonna take that sublet, or what?

Rafe: Would you like to address the comments Ms. Mitchell's been making about your character?

Billy: Have I gambled? Yes. Do I tip a bottle a little too much every once in a while? Yes, but you have to understand, despite some missteps any man can make, I am first and foremost a loving father. Delia is my highest priority.

Rafe: Thank you, Mr. Abbott.

Landon: You used the word "Missteps." Such a small word to describe the magnitude of your irresponsibility.

Rafe: Objection.

Judge: Sustained. Stick to the questions, Counselor.

Landon: Let's start with your gambling. Isn't it true that you were so out of control, your family had to cover your debts and then send you to Hong Kong in order to keep a tighter leash on your activities?

Billy: I was younger and reckless back then, and it wasn't like I was locked away in some compound in Hong Kong. I was running a division of my family's multimillion-dollar company, Sir. Yes, on paper, it's true I might be unemployed, but if you take a look at my bank statements and my portfolio, I'm not in danger of being mistaken as a pauper anytime soon. And I resent the implication that I sold "Restless Style" to cover gambling debts. That's not true. Yes, I do live in a trailer by choice. I'm giving my wife space as we work on our marriage. I, too, could live in the Chancellor mansion if I wanted to. My mother lives there. I was in jail because I wouldn't reveal a source. It's called journalistic integrity. I lost custody of my other daughter due to some very complex circumstances.

Landon: Mr. Abbott, is it true my client made her misgivings about hiring Ms. Jana Hawkes as your children's nanny known? And that she even said Ms. Hawkes was dangerous?

Billy: Yes.

Landon: Ms. Hawkes kidnapped your children, did she not?

Billy: Yes, one of the biggest regrets of my life.

Landon: Hindsight, Mr. Abbott. Perhaps if you had listened to the mother of your child who clearly has her daughter's best interests in mind, this kidnapping could have been prevented. I don't see how this court can consider you a likely candidate for custody, full or shared, with such disregard for your children's welfare.

Leslie: (Sighs)

Diane: Did you hear from the D.A.?

Leslie: Yes. So if the information you provided is accurate, they won't pursue federal criminal charges.

Diane: No jail time?

Leslie: No, none.

Diane: (Sighs) But there's something else, isn't there?

Leslie: Yeah, the S.E.C. is insisting on imposing a fine, and since millions were made in the stock fraud, it's--it's not a small one.

Diane: (Laughs) They think I have this kind of money?

Leslie: Yeah, well, the amount is based on what they speculate one would have made if one had profited from the fraud.

Diane: Well, going to jail and being away from Kyle clearly isn't an option, so... even if it means losing my shirt, or, in this case, my entire closet, I'll pay the fine.

Eden: You know, I'll take the apartment.

Kevin: Great. I'll let Heather know so she can send over whatever paperwork you need to sign. So what about you, Noah? Are you headed back to New York?

Noah: Uh, well, now that my mom's back in town, I should probably stick around.

Kevin: Cool. Well, it's a good thing you guys are pals. Otherwise, it could be weird, both of you bein' in the same town, you know?

Noah: (Sighs)

Kevin: See ya.

Noah: (Sighs) Thanks again for the butt-kicking. My mom was pretty down in the dumps about being in jail. But at least I was able to give her some good news. Adam could be close to finding evidence that proves she didn't kill Skye.

Adam: Why didn't you come to me?

Sharon: Adam, it was too risky. You could have gotten in trouble. That was the last thing I wanted to have happen.

Adam: Do you know why I was there?

Sharon: Because my death was ruled a suicide, and you fought the coroner's report. I read the interview you gave.

Adam: The Sharon that I love wouldn't put her family through something like that.

Sharon: Adam, I'm so grateful for everything you've done. Noah said that you might have some evidence that would prove that I didn't murder Skye.

Adam: I wish... that he hadn't said anything. I... I hate that it got your hopes up. He misunderstood. I thought I had something, but it didn't pan out.

Sam: You won't have to worry about the swindler vet taking advantage of Sharon anymore, Sir. I'm heading back to New Mexico as soon as I confirm that she'll be adequately taken care of.

Victor: She will be.

Sam: Good.

Victor: Uh, Dr. Gibson, I'm not sure if you're aware, uh, Sharon has fallen for my son Adam.

Sam: Is that the guy that's in there now?

Victor: Yeah. He's trouble.

Sam: Why would you talk bad about your own family, Sir?

Victor: That's a long story. But I know that you're a good influence on her.

Sam: Am I?

Victor: You're a good man. So what I'm asking you is to stay and help Sharon. She needs you.

Billy: (Sighs)

Rafe: Look, I can make up some ground in my closing, but, honestly, Billy, it's not looking good here. I-I don't see any way to swing the momentum back to our side.

Billy: (Scoffs)

Victoria: Uh, your honor? Um, I'm Victoria Abbott. I'm Billy's wife, and I would like to testify on his behalf.

Next on "The Young and the Restless"...

Lily: And next time that you "Accidentally" run into my children, I will have no problem putting you in jail.

Chloe: What the hell was that? That was an absolute disaster.
