Deveraux house:

Jack works at his computer as he tells Frankie how much he appreciates that Frankie has agreed to keep his secret about disappearing. Jack insists that he won’t put Jennifer and his family through watching him suffer a slow and painful death. Frankie asks Jack to think about how angry and upset Jennifer will be just as Jennifer walks in and demands to know what they expect her to be angry and upset about.

Penthouse:

John has insisted that he and Marlena return home to discuss the fact that Marlena has just requested a divorce. Marlena doesn’t see that they need to talk any further but John insists that they discuss it and turns to Alex, who has come home with them, as he adds that he wants to talk to Marlena in private. Marlena talks about having their lawyers do the talking and how she won’t be asking for alimony. John is shocked that Marlena would be doing this today of all days and has to remind Marlena that today is her birthday for which he had made special plans. John adds that his plans would make Marlena feel differently about things.

Police station:

Kate can’t understand how listing Sami’s crimes as Stan has helped Austin save Sami’s life. Austin insists that by listening to Kate, it has clicked that Sami cannot be prosecuted for the crimes she’s accused of and thanks Kate. Austin ignores Kate’s retort and asks Roman to be let into the office because he has something important to say. Roman opens the door to let Austin in and Kate rushes in before Roman can close the door. Sami tearfully tells Austin about how she could be executed for treason. Austin vows to Sami that he won’t let that happen.

Deveraux house:

Jennifer repeats her desire to know what Frankie and Jack were talking about. Jack covers by claiming he is working on a research project and thought Jennifer would be disappointed to learn that he was working on a research project without asking for her help. Jennifer presses for details but Jack insists that the project is confidential. Jennifer protests but Jack insists that this time he needs to do it on his own. Jennifer asks Frankie for details but Jack pipes up to confirm that while Frankie does know about it, he’s been sworn to secrecy. Jennifer is upset that Frankie would be able to know but not her. Jack promises that in time all will be revealed and Jennifer will see why he couldn’t share it with her. Jennifer agrees not to push and offers coffee. Jack tells Frankie and Jennifer to go help themselves to the coffee while he continues working. Jennifer and Frankie head into the kitchen and Jack returns to his quest of finding an expedient and painless way to die.

Penthouse:

Marlena is surprised to learn that it is her birthday but does not show any excitement about it. John mentions his plans again and Alex complains that John didn’t run his plans by him first. John angrily tells Alex to stay out of it but Marlena tells John not to take his anger out on Alex. John wants to know why Marlena is suddenly asking for a divorce when only a moment ago she seemed close to a breakthrough. Marlena declares that she doesn’t love John. John tries to convince Marlena that it’s only because she doesn’t remember. Marlena claims that if she truly were in love with John, she should at the very least not feel as if he is a stranger and she feels that way about John, which makes it uncomfortable to live with him. John assures Marlena that her memory will come back and she will remember loving him. Marlena complains that John is pressuring her and trying to undermine Alex as her doctor and tells John that she needs him out so she can be alone. John realizes that Alex is the one behind Marlena’s change in mood.

Police station:

Sami starts to cling to the hope of being released but Roman steps up to insist that the charges are serious. Mickey suggests that offering a plea bargain is a better chance than trying to beat the charges completely and wants Sami to plead guilty on the condition that the death penalty is taken off the table. Austin tells Mickey that there isn’t going to be a need for a plea bargain for if he is right, there might not even be need for a trial. Kate tries to get Austin to see that there is definitely going to be a trial because of Sami leading all five guys into Tony’s trap. Roman agrees with Kate and adds that all five guys will bear witness to that fact and will be given subpoenas to testify. Kate remarks that the guys will be happy to testify because of how they trusted Stan only to have Stan almost get them killed. Sami maintains that she didn’t want any of the guys to die. Sami wants Austin to explain what he means by no use for a trial. Austin acknowledges that he isn’t saying that he can prove Sami’s innocence but insists that there is no way that they can prosecute Sami for the things that she is being charged with.

Mickey holds up the indictment and insists that there is no way Sami can deny that she did pose as Stan and did lead US citizens to an enemy in a country that is currently involved in war. Austin claims that the facts are wrong and Roman allows Austin to make his case. Austin has Sami relay exactly how she came to work for Tony. Austin insists after hearing Sami’s retelling that her actions don’t qualify as treason. Austin points out that the guys were not there as military personnel but were even wanted by the military for escaping protective custody. Austin adds that Tony was never declared a real enemy. Roman points out that Tony was a wanted criminal but Austin repeats that Tony wasn’t an enemy of the country and that technically Sami turning the guys over to Tony probably saved them from being killed or captured. Sami latches on to this theory. Kate scoffs at the theory by pointing out to Sami that Tony was planning on killing the guys but Sami claims that she believed Tony’s promise of not hurting them. Kate groans as Austin declares Sami a hero for saving the guys and repeats that it can’t be treason because Sami wasn’t working under the jurisdiction of the US military. Roman and Mickey acknowledge now that Austin might be right. Sami laughs and sobs in relief.

Deveraux house:

Jennifer is gushing about plans for Jack’s party but Frankie is lost in thought. Jennifer notices that Frankie is distracted and asks if he’d like to talk about what is bothering him. Frankie tells Jennifer that he doesn’t think this party for Jack is a good idea.

Jack finds what he wants as he searches The Spectator’s archives online. Jack chuckles as he peruses the list of ways to “shuttle off this mortal coil.” Jack flashes back to telling Lexie about how he refuses to tell his family about his prognosis. Jack searches through the choices and decides that electrocution, suffocation, and slitting one’s wrists are not the right choices and continues searching.

Penthouse:

Alex insists that he has nothing to do with Marlena’s request for a divorce and Marlena confirms it. John refuses to believe it and Alex starts to repeat Marlena’s wishes but John wants Alex out so he can talk to Marlena alone. Alex says he’ll leave if that’s what Marlena wants but Marlena tells him to stay. John decides then to pull Alex aside to talk and starts the talk by saying that he’s had it with Alex. Alex quips that the feeling is mutual and also shared by Marlena. Alex claims that John has brought this all on himself. John puts the blame on Alex by accusing him of trying to keep him and Marlena apart from day one. Alex claims it was all to help Marlena retrieve her memory and repeats his warning about leaving the cabin. John is confident that Alex is behind Marlena’s request for a divorce and grabs Alex by the neck of his shirt as he threatens to throw Alex off the balcony if he doesn’t leave his house.

Alex counters by telling John that throwing him off the balcony would cause a confrontation with Marlena that John wouldn’t want. John lets go of his hold on Alex’s shirt after looking back at Marlena’s angry expression. John repeats his desire for Alex to leave and suggests he use the front door. Alex agrees to go but remains confident that it won’t change Marlena’s mind. John is adamant that Marlena won’t change her mind as long as Alex keeps messing with it. Alex returns to Marlena and tells her that he wants to give her and John some time to talk and leaves. Marlena remains steadfast in her desire for a divorce, confident that nothing John can say will change her mind. John wishes to still give Marlena her birthday present and gives her a photo album. Marlena complains that this is another of John’s attempt to pressure her into remembering but is taken aback by John’s questioning of why Marlena keeps acting like getting her memory back is a bad thing. John gets Marlena to agree to open the photo album by agreeing to leave if she truly wants him to. Marlena pulls out the album, looks at the cover, and sighs.

Police station:

Sami begs Roman and Mickey to agree with Austin despite Kate’s adamant refusal. Roman and Mickey leave the office to call the DA and the US attorney to see what they say about it. Kate starts to complain about this turn of events and scoffs at Austin’s claim that Sami is merely another victim and is responsible for saving the guys’ lives. Sami claims that she was willing to die to protect the guys and claims that she’d be grateful if someone did the same for Will even if it was her mortal enemy. Kate tells Sami to spare her the antics because this attempt to make Sami out to be a hero isn’t working for her and vows that Sami is going down.

Deveraux house:

Jennifer questions why Frankie thinks the party for Jack is a bad idea. Frankie says that Jack isn’t up for a party right now. Jennifer insists that Jack is and gushes about how she’s invited everyone Jack has ever known. Frankie is hopeful that this will change Jack’s mind. Jennifer wants to know what Jack needs to change his mind about.

Jack finds a method of killing himself that he considers to be perfect and then notes how Halloween would be the perfect date. Jack sadly jokes about how he’ll be able to show Jennifer that he kept his sense of humor right up until the end. Jack receives a call from Jo and he confirms that he’ll be right over to pick up Jack Jr. Jack looks at the method of choice still on his computer screen and agrees that this is the perfect way to go.

Police station:

Austin can’t believe that Kate would really want Sami to be put to death. Kate claims that wasn’t what she want for whether she likes it or not, Sami is the mother of her grandson. Kate adds that she still wants to see Sami pay for what she did but Sami believes that she already paid for her crimes. Kate can’t see how Austin can forgive and forget that Sami was Stan and almost got the guys killed. Austin insists that none of Sami’s actions were intentional and wouldn’t have happened if Kate hadn’t interfered. Kate doesn’t think that being desperate and grieving was a valid excuse. Sami wants to know why Kate can vouch for what she does but can’t believe an excuse for her actions. Kate insists that her actions were to save lives whereas Sami was out to destroy lives. Roman and Mickey return and explain that they laid out Austin’s argument to the DA and US attorney. Roman proclaims that they have an answer. Kate can’t stand the building anticipation and demands to know the answer.

Deveraux house:

Frankie claims that he meant Jack would change his mind about surprise parties and acts surprised when Jennifer informs him that Jack has always loved surprise parties. Jennifer notes that Jack has been working on his mysterious project on the computer for hours but Frankie refuses to divulge anything. Jennifer is confident that she’ll get it out of him and decides to make Jack take a break.

Jennifer and Frankie take the coffee in to Jack. Jennifer offers the coffee to Jack but Jack accuses her of trying to get him jacked up on caffeine so he’ll start talking. Jennifer tries to get Jack to take a sip of coffee but Jack refuses. Jack uses the need to go pick up Jack Jr. as a quick escape. Jennifer calls after him to note how this research is making Jack so excited. Jack quips that the research is life altering before leaving. Jennifer asks Frankie to tell her what is going on but Frankie only claims that Jennifer will find out soon enough. Jennifer starts to wonder if Jack is planning a surprise party for her but Frankie assures her that that isn’t the case. Jennifer notices that Jack left his jacket and rushes to get it to him but then notices that Jack’s pill bottle falls out of the jacket pocket. Jennifer wonders why Jack is taking this specific prescription drug and Frankie tries to claim that it was for Jack’s vertigo. Jennifer doesn’t buy that reason because she recognizes the drug’s usage from her time with Bill in Africa.

Penthouse:

Marlena looks over the family photos included in the album as John describes what each photo is from. Marlena looks uneasy as John compares her beauty to Belle’s beauty. They laugh as John flips the page to a picture of Brady with an unhappy expression on his first day of cub scouts. John tells Marlena about how she encouraged Brady to tough it out and now today he’s an eagle scout. Marlena laughs at the next picture and John explains that it’s from a date they went on. John flashes back to when they dressed up in 50’s attire and went out on the town. Marlena’s momentary happiness fades as she flips the page and sees the photo from their wedding. John flashes back to saying his vows at their wedding. John repeats to Marlena their vow of not parting until death parts them and it makes Marlena uncomfortable enough that she decides not to look at any more pictures and closes the photo album. John asks if the pictures sparked any memories but it hasn’t despite the tear Marlena now wipes from her face. John begs Marlena to give them a chance to make even more memories and points out that his whole past is a blank too. John entices Marlena to change her mind by gushing about how he considers their family to be his whole life and how that life is fuller than any man could ever wish for. John is confident that once Marlena remembers, she’ll see that nothing has changed and nothing could change the way they feel about each other. John tells Marlena that he loves her and that he knows she still loves him. Marlena relishes in John’s caress of her face as he speaks these words and prepares for their kiss. Just as John leans in to kiss Marlena, Marlena’s cell phone rings. Marlena backs away insistent on answering the phone but somewhat shaken by the moment that almost was.

Penthouse & hallway:

Marlena answers her phone and it is Alex calling on his cell phone from the hallway. Alex tells Marlena to listen to the music and then she will know what she has to do. Alex holds the tape recorder up to his cell phone.

Police station:

Roman reveals that the DA and the US attorney both agree with Austin’s argument. Kate collapses into the chair in shock and disbelief. Mickey shakes Austin’s hand in thanks. Sami asks Roman for the bottom line and he declares that all the charges have been dropped and Sami is free to go. Sami enthusiastically hugs Austin in thanks. Austin tells Sami that she needs to thank Kate for if Kate hadn’t reminded Austin of all the things Sami had done, he wouldn’t have realized that they had to let Sami go. Sami turns to Kate and thanks her. Kate looks around at everyone and puts her head down on the desk.

Penthouse & hallway:

Marlena is entranced as she listens to the music. Alex continues to hold the tape player up to the phone. John asks Marlena who is on the phone but Marlena doesn’t say a word. John grabs the phone from her and asks the caller if they are Alex. Alex stops the music and hangs up the phone without saying a word. John checks the caller ID but it only says unknown caller. John asks Marlena to confirm that it was Alex calling but Marlena claims it was a wrong number. John decides to believe Marlena and steps close in an effort to continue their conversation. Marlena’s demeanor is no longer loving but has returned to the more stoic and emotionless stance. Marlena tells John that she can’t take another pointless walk down memory lane for she doesn’t remember any of their past and doesn’t believe they have a future. John can’t believe what he’s hearing. Marlena declares that she wants a divorce and she wants it now.

Deveraux house:

Jack remains on the front porch and breathes heavily as he debates whether to go through with his plan. Jack decides that it’s better than having his family watch him die and proclaims that come Halloween, he is out of here. Jack leaves.

Frankie watches Jennifer work on the computer. Jennifer searches for the drug’s name on the computer. Frankie tries to convince Jennifer that the drug is an antibiotic. Jennifer finds a site that verifies that this drug is used to treat a condition that is fatal. Jennifer begins to cry as she frantically searches on the computer for more information in hopes of disproving the claim that Jack is dying.
