Episode #12964 ~ Chad & André have their say during Hope's sentencing; Justin lays out his case for leniency to the court, insisting that Hope was suffering from mental distress; the judge pronounces Hope's sentence; Brady finds Theresa in a compromising position.

Theresa: I'm ready.
Shane: For a while there I wasn't sure you'd be walking out of here. Healthy or-- or even alive. Oh, my God, I couldn't bear that, my sweet, little girl.
Theresa: I'm so sorry. It just--it's just when I was hopeless, Dad. I mean, Brady's love is... stronger than I could've ever imagined, but he has to let go. He just has to.
Shane: And I will help you...
Shane: In any way I can, but if I think for a single second that you can't handle what's about to happen--
Theresa: No, no, I can, Dad. I can. I have to. I can do this. It just... when I thought that I couldn't save them that I lost my way. I know what I have to do. I will never be weak again.
Brady: Anne, no, you're wrong. This is not typical of her. Not anymore. She always makes a point of being here for his bedtime. [Stammers] Anyway--just anyway, if you hear anything, will you let me know, please? Thank you.
Nicole: Brady? Are you okay?
Brady: She said she loved me and Tate. She said that we were the only things she ever needed in the world and that I knew her better than anyone in the world. And, now... I don't even know her at all.
Justin: I no way do I wish to diminish the fact that a man was murdered. But I intend to prove that the person who pulled the trigger-- a decorated police detective is not the cold-blooded vigilante the prosecution would have you believe she is. That in the defendant's mind, when she shot Stefano DiMera, she was protecting herself and her family from a man who presented an imminent threat to her life. When a mother's children are in danger-- when a wife's husband has been tortured and has died in her arms-- when years of captivity and abuse and persecution overwhelm you, and the monster before you owns it all and laughs with delight as you emotionally unravel before him, what would you do? What would anyone do?
Justin: By strictly confining this case to the day Stefano DiMera was shot, district attorney Trask is ignoring the motivating factors that led Hope Brady to show up at the DiMera mansion in the first place. She's approaching this case as if these two people-- the victim and the convicted, were strangers when as we all know, they shared a long and complicated and, yes, extremely violent history. A history that the court must weigh in its entirety when taking into account the defendant's motive and possible premeditation on the day in question. I present to the court, exhibit A. You've already heard the case against Hope Brady, here is the case against Stefano DiMera.
Trask: I object! I will not allow defense counsel to put the victim of this heinous crime on trial here!
Justin: If only I'd had that chance, but since Stefano always found ways to avoid standing trial for any charges--
Judge: All right! Overruled. Why don't you share the contents of the file with the court, Mr. Kiriakis?
Justin: As you wish, your honor. This folder contains 13 depositions of witnesses attesting to a time when Stefano held my client prisoner, keeping her from her loved ones, perpetrated calumny, an elaborate lie on the people of Salem, so that they all believed Hope was dead. They grieved for her. They mourned. And Stefano laughed.
Trask: Seriously, your honor, is the court going to dignify this attempt by defense counsel to justify his client's actions?
Justin: It also contains witnessed accounts whereby Stefano enlisted officers of the law and the court, using various forms of bribery and coercion, to have all the ensuing charges dropped... or made to disappear altogether. May I approach? Amazing who can be bought and sold if the price is right.
Trask: Again, your honor, I strongly object to the use of anything inside that file--
Judge: Overruled! I will examine the documents contained in the file and give them appropriate consideration along with any and all testimony presented today before making my ruling.
Justin: Thank you, your honor. Your honor, the law states clearly that an individual may use deadly force in an act of self-defense if they reasonably believe it is necessary to prevent another individual from inflicting great bodily harm or death. Would you agree with that?
Justin: Given the history of violence perpetrated on Hope and her family by one Stefano DiMera, how could she reasonably believe he wouldn't inflict the same torture she had endured in the past? In my hand are two psychiatric evaluations of Hope Brady's mental state.
Trask: This is irrelevant, your honor.
Judge: I'll allow it.
Justin: Two separately conducted reports which concur that the defendant suffered intense emotional and mental stress as a result of repeated trauma, proving that when Hope Brady pulled that trigger, she did so as a reaction to years of relentless torture. And always, while Hope was at his mercy, Stefano laughed. The doctors also corroborate that at the time of the shooting, Hope Brady was, most likely, in a fugue state and clearly not in control of her actions. Therefore, your honor, based on these reports, I conclude this was not a case of premeditated murder. Not an act of vengeance or vigilantism. But was, instead, the reaction of a woman who felt threatened and, acting on pure instinct, carried out an act of self-preservation. And now, with the court's permission, the defendant would like to tell, in her own words, what she remembers about the day in question.
Judge: Permission granted.
Justin: The defense calls Hope Brady to the stand.
Theresa: You know, I need to thank aunt Kayla for saving my life... and for checking me in here under a different name so brady'd never find out.
Shane: You should thank Victor, too. He's the one who found you unconscious in your bedroom.
Theresa: You know, one ray of light through this whole thing has been the way Victor stepped up. He didn't have the power to combat Mateo in open warfare, but he has been sympathetic to my cause. And he--he hasn't judged me once. Now he saved my life.
Shane: It's not just Brady you need to be hiding from. I'm worried Mateo may have got wind of this and I wouldn't put it past him to take advantage of your unconscious state to whisk you away. That's why I'm gonna have a man on you as soon as you leave here. You won't see him, but we can't take any chances.
Theresa: Yeah, you're right. Mateo's definitely getting impatient with me tying up loose ends with Brady. Which means I'm gonna need to speed up the process of breaking things off with Brady.
Shane: I'm so sorry you have to go through this.
Theresa: I know. But hey, what's the saying? Old sins cast long shadows. You know, I set all this in motion a long, long time ago. And I have to see it play out.
Shane: I know. It's--it's one thing for me to put myself in danger-- I've been trained to do that, but you, on the other hand--
Theresa: I don't have a choice, Dad. I can do this.
Shane: I know you can.
Theresa: Well, I promise you, no more drugs, no more desperate hopelessness. I can do this. Love will be my motivation. Love will be my strength.
Brady: It's almost like she's pushing me away on purpose, Nic, you know? But for the life of me, I can't--I can't understand why. 'Cause a few weeks ago, she--she was telling me how happy she was. That--that me and Tate, we... made her life complete.
Nicole: Well, that'll do it.
Brady: That'll do it? What do you mean?
Nicole: Well, whenever I get close to being really, really happy, I always find a way to screw it up. I mean, you've observed that for years. You know, maybe that's what Theresa's doing. You know, and if it is-- and for whatever reason, she's reverting back to her old ways. Brady... it's not because she's stopped loving you. Maybe she just doesn't... trust that love yet.
Brady: I thought about that. And it doesn't make sense because she said she's been feeling this way for a long time now. That she's been trying to work it out, but she just can't get over the boredom of, uh-- of her life and me.
Nicole: Oh, come on. You are a wonderful man who loves her unconditionally and you have this beautiful baby boy.
Brady: I know. You know, she also said she said that when we, uh, exchanged our vows... she was stoned. That's what she said.
Nicole: No, you--you of all people would've known that. You would've seen it.
Brady: Right, I thought I would've seen it, right? But I-I didn't. I mean, maybe I was oblivious to it. Maybe I didn't--maybe I didn't want to see it. Maybe I didn't wanna see the signs because I didn't want to face the truth.
Nicole: Brady, I'm sorry.
Nicole: Oh, may I?
Brady: Of course you can.
Nicole: Whee. Hi. Hi, buddy. Hi. Hey, it's me. Huh? [Chuckles] Oh, my goodness.
Brady: Theresa used to-- she used to look at him like that.
Brady: She used to dote on him. She used-- she wouldn't allow him cry for more than ten seconds. She would read to him when he was awake. She would... take thousands of photos of him. She doted on him, I mean... but a couple weeks ago, it just changed.
Nicole: How so?
Brady: She avoided him. She's been avoiding him and it's like--it's like it's hurtful for her to be around the poor guy.
Nicole: Yeah, well, um... babies change everything, huh? Yeah.
Brady: They do, right?
Brady: Changed me. She said it changed her. She said that motherhood... saved her, but, I mean, was that a lie? I mean, Nicole, I know you think that maybe she felt like she wasn't deserving of love or something, but... I just don't understand how that could be the cause of it. Is that why she relapsed? The drugs and the alcohol? Is that why she feels like she's trapped in a marriage? Because one minute she's this loving mother and the next minute she's full of... resentment... and anger. It's not right. I want to know why and I want to know what triggered it.
Nicole: Okay. Okay.
Hope: I'm--I'm supposed to tell you what happened the last time I saw Stefano DiMera... but the truth is, your honor, is that, um... the details of that day, they aren't--they aren't very clear. I mean, I do remember going to the DiMera mansion to confront Stefano. I wanted him to confess to the kidnapping and torture of Bo Brady. All of the evidence pointed to him and I was so sure and I was so convinced that he was behind all of it. And, as Mr. Kiriakis just pointed to you, he'd done the same exact thing to me.
Trask: Objection! The victim's past behavior is completely irrelevant.
Judge: Sustained. Continue, Ms. Brady.
Hope: I didn't go to the DiMera mansion with the intent to kill. I went in search of the truth. I honestly don't remember pulling the trigger... but I did. And whatever-- whatever my fate holds... and the court decides... I honestly will never forgive myself for what I did. I am responsible for what happened. And I will live with that the rest of my life and carry it with me.
Judge: Does the defense have anything else?
Justin: Nothing further, your honor.
Judge: You may step down.
Trask: We will now hear from the victim's family.
Brady: Kim, it's Brady. Listen, I'm--I'm sorry to keep bothering you, but things with Theresa are escalating. She did not come home last night and if you have any idea where she is, will you... please call me and let me know. Hey, okay, let me-- I gotta get him into his car seat.
Nicole: [Groans] Just a few more minutes? Please.
Brady: Nicole, I gotta-- I gotta take him. I gotta--I gotta go--
Nicole: Well, you know, I-I-I can stay with him if you'd like. I mean, Deimos just texted me and told me we can't meet anyway. I can take him to the park if that's okay with you.
Brady: Are you sure? I mean, that'd be great.
Nicole: Yeah, are you kidding?
Brady: Are you positive?
Nicole: I would love it. Yes, please?
Brady: All right. Okay. Absolutely.
Nicole: Thanks. You're gonna look for Theresa, aren't you?
Brady: Yup. And when I find her, we're gonna settle this. Once and for all.
Nicole: Careful. It's just us.
Theresa: I'm not stalling, Mateo. Getting Brady to let me go is just taking longer than I thought.
Mateo: I can make sure he lets go permanently. Him and his little ninito.
Theresa: I told you that I would come with you and I will. I just--I need to figure out my next move. But once I, uh-- I see that--that I've gotten through to Brady, you can make plans to leave.
Mateo: I know something you can do. Something that will make Brady hate you and never want you back.
André: And I cannot deny that I went into extreme measures to bring the true identity of my father's killer to light. But when that person turned out to be someone who was well-respected and beloved-- a member of Salem's finest-- someone, I believed, her "boys in blue" would protect her at any costs-- I couldn't help but worry that all the effort that was put in to bring this killer to justice--my father's killer, that it might be eclipsed by an opposing force... perhaps members of the Salem pd itself, and yet...
Hope: [Whispering] You said he wouldn't give Roman and Rafe away. He gave me his word.
Justin: [Whispering] He's just toying with them and you.
André: Here we all are, awaiting punishment for the guilty party. And all my fears of cover-ups and lost evidence is finally put to rest. So, your honor, therefore, I will not make any request in terms of severity-- in terms of punishment. I have faith in the court and the law of the land that justice will be finally served fairly.
Judge: You may step down.
So last year we were invited to Thanksgiving at the Anderson's. That's my holiday.
[Cell phone rings]
Theresa: [Clears throat] Mateo told me to be expecting your call.
Guillermo: When my boss wants you to do something, you don't ask a lot of questions.
Theresa: Well, I'm sure Mateo appreciates your loyalty.
Guillermo: Oh, you know it. So where you want to meet, chica?
Theresa: Salem Inn. Room 514.
Guillermo: On my way.
Chad: There's, um-- there's no denying that my father should have been dragged into a courtroom and forced to stand trial many, many times. That's not lost on me. But this is not one of those times. Stefano DiMera is not on trial today. For that matter, neither is Hope Brady. She's already admitted to shooting my father. And since she did confess and there is no question... that she's guilty, all I ask is that she's held accountable for her actions. Now I'm well aware that there was no love lost between my father and the citizens of Salem. However, when Hope Brady took his life... love, um, was lost. His love... for his family... for me. The opportunity for me... my brother... his grandsons, Theo... and Thomas to... love him back was also lost. And that saddens me because it had been-- it had been my hope that-- that someday that love would inspire my father to become a better man. To change. The same way my son Thomas has done for me. He makes me want to... be somebody that you can look up to... and believe in... and trust. And if his love can do that for me, then... I could've only hoped that mine and his--his family's love could've done the same for him. Someday. But Hope's actions robbed us of that chance. On the day in question, Hope went into the home where my son now lives and murdered my father. And yet, because of his past sins, all of you are gonna sit in this--this court and expect that--that she get off easy? Despite the fact that when she went into that home, my father, he was unarmed. Infirm. And frail. And the only visible threat was... the memory of what he had done in the past. Hope... I married into your family. You are my family. But I can't sit back and watch silently as you get away with what you have done. I can't. I can't. I'm sorry. [Clears throat] I ask... that the court render the appropriate punishment towards Hope Brady for the murder of Stefano DiMera. As to what that punishment is, I trust and will be satisfied with... whatever decision the court renders.
Trask: The prosecution has nothing further, your honor.
Judge: The court will adjourn for deliberation.
Julie: Hope, darling.
Justin: Come on. You gotta go.
Julie: I love you. We love you, sweetheart. Be strong.
We all need a hug in the morning
[Gentle dramatic music]
Brady: Theresa! Theresa, are you back? Ter--
[Line trilling] Nicole, hey, it's me. Listen, um, I know you're probably still at the park with Tate, but I'm ho--
[Phone hangs up]
Hell are you doing?
Adrienne: You were brilliant.
Justin: I hope it was enough.
Trask: No way in hell is Fitzpatrick gonna buy that Hope Brady was mentally incapacitated-- or that shooting DiMera was an act of self-preservation.
Steve: Hey, let me tell you something, lady. Anyone of us in this room could've pulled that trigger and made the same claim! Hope Brady deserves a medal for putting us all out of our misery.
Kayla: Steve. Steve. Come on.
Steve: Maybe if Fitzpatrick throws the maximum sentence at her--
Kayla: Don't even go there. Please just don't even go there. Come on. Come on.
André: I have to tell you... you did really well. Father would've been proud of you.
[Cell phone vibrates]
André: Oh. I've gotta take this.
Jennifer: What you said... about being family... I want you to know that... that's never gonna change. I will be here for you.
André: Yes, Laura, you heard me right. Yeah, Abigail is here in Salem. No, I haven't told my brother. And I don't intend to. Well, at least not yet. I'll call you back. If you're looking for a quote to jumpstart your newly acquired paper, I suggest you speak to the court secretary for-- for a transcript. I'm all talked out.
Jennifer: It's about Abigail.
André: What about her?
Jennifer: If she were here, I-I feel like she would feel caught in the middle like I do right now. Hope has our family. She has all of her friends around her and Chad--
Jennifer: My daughter would not want him to feel alone.
André: Oh, you're absolutely right. Chad shouldn't be alone. As a matter of fact, I was just gonna go inside and join him. Would you care to?
Judge Fitzpatrick has a ruling.
Julie: That didn't take very long. Is that a good sign?
Justin: I wish I knew.
Rafe: Fitzpatrick's on her way back in.
[Hope sighs deeply] I don't have any problem confessing to what I did. You don't have to go through this alone.
Hope: I'm not alone. I haven't been through any of it... because you've been right by my side the whole time. I love you.
Rafe: I love you.
Hope: Let's go.
Rafe: Let's go.
Brady: Theresa. Theresa!
[Theresa continues to laugh]
Brady: Theresa, open up! I can hear you in there! Open up the door!
Bailiff: All rise.
Judge: Please be seated. Except for Ms. Brady, who should remain standing. Since I see no cause for special circumstances in this case, the death penalty will remain... off the table.
Judge: With regard to the charge of murder in the first degree, I've reviewed the psychiatric reports on Ms. Brady's mental state and have given them careful consideration. I agree with the defendant's assertion that premeditation was not involved in the shooting of Stefano DiMera. Therefore, I am sentencing Hope Brady to the maximum time allowed by law for second degree murder. Twenty five years in a maximum security facility with no possibility of parole.
[Gavel pounds] Order in the court!
[Indistinct shouting continues]
[Gavel continues to pound]
Guillermo: So you came to join the party or what?
Brady: Shut up.
Theresa: Hey, don't be rude to my friend, Brady.
Brady: I'm sorry, you're "friend"?
Theresa: Well, we just met, but I can already tell he knows how to show a girl a good time.
Guillermo: What the hell?
Order! Order in the court! I need quiet right now!
Kayla: For crying out loud!
Yeah, go ahead. Run and leave.
Rafe: This is not justice!
Jennifer: Rafe! Rafe!
Rafe: What the hell are you doing?
Roman: Rafe! Rafe!
Rafe: How the hell you deny her parole?
Roman: Rafe, this is not good for the case.
Rafe: What case? There is no case. Fitzpatrick got a chance to take Hope down and she went for it.
The defendant will be remanded into custody immediately. Case closed!
Justin: I'm so sorry.
Hope: No, Justin, don't. You did everything you could.
Rafe: Hey. Hey. Get your hands off her. Get your hands off her.
Hope: Rafe, he's just doing his job. Just let him do his job.
Rafe: No, I'm not letting you go like this.
Hope: It's okay. I'll be okay. It's okay. I'm fine. Please, just right now take care of Ciara. Take care of Ciara for me. Please.
Ciara: No! Mom--Mom, I'm not gonna let them take you.
Hope: Ciara, baby girl, listen to me. I am okay. Look into my eyes. I'm okay.
Ciara: [Crying] No!
Hope: We'll get through this.
Hope: We will.
Ciara: I just want you to come home, okay? I just want you to come home.
Hope: I know. [Whispers] I know. Let's go.
Rafe: Be careful.
Julie: Oh, baby.
Rafe: Oh, my God.
Julie: Darling, you gotta get her. God knows what she'll do. Ciara! Ciara, come back!
Adrienne: Justin, I'm so sorry.
Steve: Hey. Hey. Hey! Listen, we have to fight this! We have to fight this!
Roman: We'll file an appeal.
Kayla: We can't let this happen to her.
Shawn: We gotta find a way to turn it around.
Justin: If there's a way, I will find it.
Rafe: Well, it's damned sure not gonna end this way.
Shawn: You're damned right.
